In a move that child safety advocates say will save the lives of thousands of children, President Bush today signed The Virginia Graeme Baker Pool and Spa Safety Act of 2007. The legislation provides incentives for states to adopt comprehensive pool safety laws that will protect children from life-threatening injuries and horrible deaths from dangerous pool & spa drains. The law, which was included as part of a comprehensive energy bill (H.R. 6), passed the House on Dec. 18 by a vote of 314100. The Senate approved the bill on Dec. 13. The law is named for the granddaughter of former Secretary of State James A. Baker, III, who joined Graeme's mother, Nancy Baker, and Safe Kids USA in a three-year advocacy campaign for the legislation. In 2002 at the age of 7, Graeme Baker died in a spa after the powerful suction of a drain entrapped her under water. "While the loss of our beloved Graeme will be with us always, our hearts have been lifted by the passage of this common-sense piece of legislation that will save lives," James Baker said. "We are grateful to President Bush and the members of Congress who are making sure other children are protected from the kind of accident that took Graeme from us." Nancy Baker agreed. The legislation includes a directive for the CPSC to establish a safety standard for anti-entrapment drain covers. This would ensure that all drain covers available in the marketplace would conform to certain safety criteria. - Create an incentive grant program for states to adopt comprehensive pool and spa safety laws requiring certain safety devices in swimming pools and spas to protect children. The legislation would provide grants to states that pass a comprehensive swimming pool and spa safety law. The bill would require states to use funds, if awarded, to hire and train personnel for the proper enforcement of state law; and educate pool owners and operators, pool construction and installation companies, pool service companies and the public about the state law and about drowning prevention practices. - Establish a national drowning prevention education program within the U.S. Consumer Product Safety Commission. A homeowner has installed an above-ground swimming pool with a single submerged main drain (suction outlet). He proposes to re-pipe the pool filter system to a configuration that causes the main drain to become a discharge outlet rather that a suction outlet, as presently configured. When the pool filter is re-connected after a winter layup, or at any time for that matter, a simple piping change will result in the main drain again functioning as a drain and not as an outlet. My findings were based on code section AG 106.4 the 2003 International Residential Code Portion of the 2005 State Building Code State of Connecticut. This finding is further supported by an official interpretation from the state building inspector (copy of enclosed). Please be advised that a certificate of occupancy will not be issued until this deficiency has been corrected. Use of a pool without a certificate of occupancy is a violation of Connecticut building code. Regards &~Iq ~David M. Deputy Building Official cc: File STATE BUILDING CODE INTERPRETATION NO. 1-24-07 October 19, 2007 The following official interpretation is offered in response to several questions received by this office regarding the entrapment avoidance provisions of Section AG106 of the 2003 International Residential Code portion of the 2005 State Building Code. Question 1. If a pool filtration system relies only on skimmers and has no submerged drain, must there be a minimum of 2 skimmers separated by 3 feet? Must there be an SVRS device? Answer 1. No to both questions. The current code does not make a distinction between the two most prevalent types of suction outlets; surface skimmers and submerged outlets (drains), nor does it require the use of main drains in pools where surface skimmers are employed. The intent of Section AG106 is to prevent three basic types of entrapment: hair entrapment; body or limb entrapment; and evisceration. Hair entrapment and evisceration are prevented by use of an intact ANSI/ASME Al 12.19.8M approved cover, which the code specifically does not require for skimmers at Section AG 106.2. Given the physical characteristics of surface skimmers that are equipped with a weir and a skimmer basket and are vented to the atmosphere through the cover; body or limb entrapment are highly unlikely to occur at a surface skimmer. For this reason, I believe that it is the intent of the code to apply the various code requirements for entrapment avoidance to submerged suction outlets (drains) only. Thus, the location and number of skimmers would be a function of water circulation to maintain water quality, and the requirements for the number of outlets, separation distance and safety vacuum relief system (SVRS) devices would not apply to pools served by surface skimmers alone. Again, Section AG106.2 specifically exempts surface skimmers from the approved cover requirements. Question 2. Section AG106.4 requires a minimum of 2 suction outlets. Can a pool be constructed with a single skimmer and a single submerged drain that are separated by three feet as long as the combined line to the pump is protected by an SVRS? Answer 2: No. Although the code uses the term suction outlets, the intent of the code is that if a main drain system is employed, there be a minimum of two such drains, each protected by an approved cover meeting the requirements of Section AG106.2 and separated by a minimum of three feet. The key here is the modifier "of the approved type" to the term suction outlet. Research into this question indicates that wherever submerged drains are employed the intent of the code is to require a minimum of two matching submerged suction outlets; that is, two submerged main drains. This requirement does not apply to pool cleaner fittings covered by Section AG106.5. Question 3. A pool has two skimmers (A and B) and a single main drain in the floor of the pool. The main drain has a compliant cover and is piped into the bottom of skimmer (A). 2" suction lines run from each of the skimmers to a tee which then goes to a pump protected by an SVRS device. Does this comply with the code's requirements to have a minimum of two suction outlets separated by a minimum of three feet? Answer 3. No. Using similar logic found in Answer 2, any pool with a submerged main drain must have two such drains separated by a minimum of three feet (see response 4). In addition, it should be noted that the intent of the code is that the tee connecting the two submerged suction outlets (drains) to the single suction line should be as close to the center of the pipe connecting the drains as possible. This helps to ensure flow rates in the two drains that are as equal as possible. The only exceptions to this law are the sole proprietor or property owner who will not be acting as general contractor or principal employer. What to give to the Building Official to obtain a Building Permit: 1. The General Contractor or Principal Employer must provide a written certificate of workers' compensation insurance for all of the employees on their project. This certificate may not be for liability, disability or any other type of insurance. 2. The Sole Proprietor or Property Owner who will n act as a general contractor or principal employer is not required to have workers' compensation coverage. In order to obtain the building permit, a FORM 7A should be completed and given to the building official. 3. The Sole Proprietor or Property Owner who will act as a general contractor or a principal employer must provide a written certificate of workers' compensation insurance for all of the employees on their project and must file a FORM 713 with the building official -OR he will'sign a sworn notarized affidavit on FORM 713, stating that he wilt require proof of workers' compensation insurance for all those employed on the job site. 4. The General Contractor or Principal Employer who has properly excluded himself from coverage using the appropriate WCC form (see NOTE below) must file the FORM 7 with the building official. This form certifies that they have properly excluded themselves, and attests that they will require proof of workers' compensation insurance from every employee that works on the designated . job site.
