I was following up on your last email to see if you had received the
study from Mr. Snarski. In addition, if I could have a letter from you
office, by May 21st , stating who has jurisdiction over the wetland area
it would be greatly appreciated. Thanks for your assistance in this
matter.

Dear Ms. Bezanson:
Thank you for the information. I have not received Mr. Snarski’s study.
I will contact him to obtain a copy. I believe that although there are
no inland wetlands, since the new dwelling construction is occurring in
a coastal management area within a FEMA V-zone or A-zone, this site is
subject to review by DEP Coastal Planning under the Coastal Management
Act, and Montville Planning & Zoning should proceed with that route.
Since Mr. Snarski does not mention anything regarding tidal wetlands in
his report, I need to obtain a copy of the study to review his findings.
I do know tidal wetlands exist on site; however, his survey is needed to
determine the limits of those tidal wetlands. A determination that
building is outside of tidal wetlands and a review by DEP Coastal
Planning is necessary before the Zoning permit can be renewed.

Ms. Lambert:
Please find attached a letter from Richard Snarski dated April 16, 2009,
indicating that he had completed the soil study at 37 Cove Road. As his
letter indicates he found no evidence of any inland wetland soils nor
any alluvial flood plain soils. It is my understanding that since
neither of these soil types were found on the property that the local
Inland Wetlands Commission has no jurisdiction in the area. Can you
confirm that you have received the study and your opinion regarding
local jurisdiction. Thanks for your assistance in this matter.
