MEETING MINUTES
April 10, 2007
December 13, 2005
CCHAIRMAN MARCUS GREGORY MAJEWSKI called the April 10, 2007December 13, 2005 Meeting of the
Montville Planning & Zoning Commission to order at 7:00 pm.
COMMISSION MEMBERS PRESENT: Commissioners Marcus, Pieniadz, Polhemus, Ferrante, Baron, Heller,
Wood, and Mastrandrea (8 regular members)
COMMISSION MEMBERS ABSENT: COHEN, and : Commissioners Toner, and Siragusa.
STAFF PRESENT: Marcia Vlaun, Town Planner.
MINUTES:
A MOTION was made by COMMISSIONER WOOD; SECONDED by COMMISSIONER PIENIADZ to
ACCEPT the minutes from the Regular Meeting of March 27, 2007. Voice vote. 8-0 All in favor. MOTION
CARRIED.
CORRESPONDENCE: none
Staff informed the Commission of the verbal discussion that she had with the Mayor relative to the
budget.
Chairman Marcus advised that due to the amount of members that would be unavailable for the 4/17/07
workshop, it would be cancelled.
NEW BUSINESS:
a) §8-24 Review: At the request of the Montville Town Council, to determine if the Town should sell the
property located at 300c Maple Avenue, Uncasville, CT As shown on Assessor’s Map 82 Lot 27. Staff
advised the commission that the lot has no frontage. A MOTION was made by COMMISSIONER
POLHEMUS; SECONDED by COMMISSIONER PENIADZ to send a FAVORABLE §8-24
Review, (to the Town Council), relative to the sale of the property located at 300c Maple Avenue
Uncasville, CT As shown on Assessor’s Map 82 Lot 27. Voce vote. All in favor 8-0 MOTION
CARRIED.
b) §8-24 Review: At the request of the Montville Town Council, to determine if the Town should sell the
property located at 275 Route 163, Uncasville, CT As shown on Assessor’s Map 82 Lot 74. Staff advised
that the property as it stands is a liability to the Town. A MOTION was made by COMMISSIONER
POLHEMUS; SECONDED by COMMISSIONER HELLER to send a FAVORABLE §8-24 Review,
(to the Town Council), relative to the sale of the property located at 275 Route 163 Uncasville, CT As
shown on Assessor’s Map 82 Lot 74. Voice vote. All in favor 8-0 MOTION CARRIED.

c) §8-24 Review: At the request of the Montville Town Council, to determine if the Town should sell the
property located at 136 Oxoboxo Dam Road, Oakdale, CT As shown on Assessor’s Map 45 Lot 12. Staff
advised the Commission that the lot contains a large amount of wetlands. A MOTION was made by
COMMISSIONER POLHEMUS; SECONDED by COMMISSIONER HELLER to send a
FAVORABLE §8-24 Review, (to the Town Council), relative to the sale of the property located at 136
Oxoboxo Dam Road, Oakdale, CT As shown on Assessor’s Map 45 Lot 12. Voice vote. All in favor 8-0
MOTION CARRIED.
ZONING ISSUES:
a) Wez Huang/Heng Ping Peng: An application for a Home Occupation Permit for a catering business on
the property located at 66 Dydo Drive Uncasville, Ct. As shown on Assessor’s Map 96 Lot 79. Staff
informed the Commission that the applicants want to run a sushi business for take out purposes only. No
employees and the applicant’s have are aware and agreed that they will also need sign offs from both the
Fire Marshal and Uncas Health. The Permit will be valid for one year and if there are any problems, then
it will be revisited. A MOTION was made by COMMISSIONER POLHEMUS; SECONDED by
COMMISSIONER HELLER to APPROVE the Home Occupation Permit for a catering business on
the property located at 66 Dydo Drive Uncasville, Ct. Voice vote. All in favor 8-0 MOTION CARRIED.
Staff addressed another Zoning issue with the Commission relative to two home occupation permits on the
same home at 236 Massapeag. Audra Hyak requested a permit for a mobile dog grooming facility while there
is a home occupation permit in place for an electrical service business at the same address. Discussion was
held and the Commission determined that the regulations currently state that only one home occupation
permit is allowed per home. A MOTION was made by COMMISSIONER PIENIADZ; SECONDED by
COMMISSIONER BARON to DENY the Home Occupation Permit for 236 Massapeag since they have an
existing Home Occupation Permit on the property and the Regulations only allow one. Voice vote. All in
favor 8-0 MOTION CARRIED.
PUBLIC HEARINGS:
a) David King: An application for a Zoning Regulation Text Amendment to incorporate the allowance of
Interior Lots in the R-40, R-80 and R-120 Zoning Districts. Chairman Marcus reopened the Public
Hearing. Discussion was held. Applicant: did not attend the meeting. Public: In favor-none Opposed-
none. A MOTION was made by COMMISSSIONER BARON; SECONDED by COMMISSIONER
FERRANTE to CLOSE the Public Hearing. Voice vote. All in favor 8-0 MOTION CARRIED. The
Public Hearing closed at 7:35 p.m.
b) Tilcon Connecticut, Inc.: An application for the continuation of a Special Permit for earth products
excavation and processing on the property located at 53 Caroline Road, Montville, Ct. As shown on
Assessor’s Map 59 Lot 7. Staff advised the Commission that the Day made an error with the legal notice
that they published, so the hearing was not properly noticed and would have to be rescheduled. The Day
will republish the legal ad at no cost to us. Attorney Heller, representing the applicant, advised that he
will be away at that time and asked if the Commission would accommodate A REQUEST TO PUT THE
MATTER ON FOR AS LATE AS POSSIBLE DUE TO SCHEDULING CONFLICTS AND THE
Commission agreed. A MOTION was made by COMMISSSIONER PIENIADZ; SECONDED by
COMMISSIONER HELLER to reschedule the Public Hearing for 4/24/07. Voice vote. 8-0 All in
favor. MOTION CARRIED.
COMMISSIONER PIENIADZ made a MOTION; SECONDED by COMMISSIONER WOOD to ADD to
the agenda, under Old Business, item 7a David King: An application for a Zoning Regulation Text Amendment.
Voice vote. 8-0 All in favor. MOTION CARRIED.

OLD BUSINESS:
David King: An application for a Zoning Regulation Text Amendment to incorporate the allowance of
Interior Lots in the R-40, R-80 and R-120 Zoning Districts. A MOTION was made by
COMMISSIONER FERANTE; SECONDED by COMMISSIONER BARON to DENY the
application for a Zoning Regulation Text Amendment to incorporate the allowance of Interior Lots in the
R-40, R-80 and R-120 Zoning Districts with the reason for the denial being that it, (the proposed text), is
not consistent with what they, (the Commission), are trying to develop for rear lot regulation. Roll call
vote: Commissioners Marcus, Pieniadz, Polhemus, Ferrante, Baron, Heller, Wood, and Mastrandrea all
voted in favor. 8-0 MOTION CARRIED. Application denied.
OTHER BUSINESS TO COME BEFORE THE COMMISSION:
a) Draft Regional Transportation Plan FY2007-2035 from SCCOG. Review of the draft was addressed
by Staff. Staff and the Commission had concerns the possibility of a future private developer being
responsible for the bridge reconstruction instead of the Mohegan Tribe as part of their expansion. A
letter will be sent to SCCOG outlining the Commission’s concerns.
b) Capital Improvement Plan. The Mayor’s Capital Improvement Plan was distributed to the
Commission. The Commission will invite the Finance Director to the next Commission meeting.
c) Census 2010 (LUCA). Discussion was held.
d) Zoning Regulation Revisions. Comments from Commissioner Siragusa were distributed to the
Commission. Further discussion regarding revisions will follow at a future meeting.
