MINUTES
October 21, 2004
7:00 P.M.
1. Call to order: CHAIRMAN BRUSH called the October 21, 2004 meeting of the Montville Inland Wetlands Commission to
order at 7:04 P.M.
2. Roll call: Present were COMMISSIONER’s BRUSH, TAYLOR, MACFAYDEN, JOHNSON, and O’DONNEL. Absent
were COMMISSIONER’s WHITTAKER and RISKE
3. Public Hearings: NONE
4. Show Cause Hearings:
a. Mark Desrosier: Activity within buffer without a permit on the property located at 442 Fire Street, Oakdale, Ct.
As shown on Assessor’s Map 14 Lot 3A. Submitted application, as requested by Commission, for brush cutting
along the road in order to improve site lines for 442 and 428 Fire Street, Oakdale, CT. As shown on Assessor’s
Map 14 Lot 3-a. COMMISSION reviewed application and maps. Discussion was held at length concerning what
has been done on the property already, and what the impact may be on the wetland species surrounding the vernal
pool. COMMISSION discussed modifying the original application to include a restoration plan. Mr. Desrosier
stated that there was an existing pile of bottles and cans that he simply covered over with the brush that he had cut
down. COMMISSION ordered no activity to take place until a site walk could be performed. COMMISSION will
visit the site independently. POSTPONED
5. Remarks from the public relating to items on the agenda: NONE
6. Old Business:
a. Jambor Family Properties LLC: An application for the construction of a residential multi-family
development and associated work with activity in wetland (1100 sq ft) and review areas (2930 sq ft) for the
property located at 1985 Norwich New London Tpke, Uncasville, Ct. As shown on Assessor’s Map 99 Lot
60. Applicant showed a rendering of what he would like to accomplish. Existing swales have filled in
naturally over time, and proposed activity by applicant would clean and extend swales into wetlands, solving
existing flooding problems. Town of Montville Engineer has inspected the plans and the site, and agrees that
the proposed activity would help to put the land back to original condition. Applicant stated that all work
would be done by hand. MOTION is as follows:
After giving due consideration to all relevant factors including those in Section 10 and or Section 4
of the Montville Wetland Regulations and Section 22a-41 of the Connecticut General Statutes, I
move to approve application 204 IWC 29 An application for the construction of a residential multi-
family development with activity in wetland and upland review areas on the property located at 1985
Norwich New London Tpke, Uncasville, Ct. As shown on Assessor’s Map 99 Lot 60 as depicted on
the plans entitled” Property Survey, Property of Jambor Family Properties LLC, 1985 Norwich New
London Tpke ( Connecticut Route 32), Uncasville Connecticut, July 30 2004, by DiCesare Bently
Engineers, Inc., Groton, Connecticut revised October 13,2004, and plan with narrative dated
October 14, 2004.
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void. Conditions are as follows: 1) Swale maintenance to be performed with
hand tools only; 2) Orange construction fence must be placed around limits of clearing; 3) All
stormwater BMP’s shall be maintained according to the measure outlines in the most recent version
of the Connecticut Stormwater Quality Manual and as approved in the permit; 4) Person’s or
organization responsible for maintenance shall be designated can be but not limited to: a) Property
owner; or b) Homeowner’s association, provided that provisions for financing necessary
maintenance are included in deed restrictions or other contractual agreements – these maintenance
agreements shall specify responsibilities for financing maintenance; 5) The person(s) or
organization(s) responsible for maintenance shall inspect stormwater BMP’s on a regular basis; 6)
Authorized representatives of the Town may enter at reasonable times to conduct on-site inspections
or routine maintenance; and 7) For BMP’s maintained by the property owner or homeowners
association inspection and maintenance reports shall be filed with the Wetland Agent in the Planning
Department on a semi annual basis.
MOTION made by COMMISSIONER MACFAYDEN and SECONDED by COMMISSIONER TAYLOR to
GRANT license. 4 IN FAVOR, COMMISSIONER O’DONNEL ABSTAINED. Motion Carried
COMMISSIONER BRUSH made note that COMMISSIONER MACFAYDEN stepped out of the room.
MOTION made by COMMISSIONER BRUSH to move New Business, Agenda Item 7.c. Jill & David Marchini to the
next item on the agenda and SECONDED by COMMISSIONER JOHNSON. 4 IN FAVOR, COMMISSIONER
MACFAYDEN ABSENT. Motion Carried
COMMISSIONER BRUSH made note that COMMISSIONER MACFAYDEN re-joined the meeting.
b. Thomas W. Alquist: An application to replace an existing septic system within the buffer on the property
located at 37 Lena’s Road, Oakdale, CT 06370. As shown on Assessor’s Map 105 Lot 50. COMMISSION
reviewed application and pictures of the property outlining proposed work. Applicant stated that existing
failing septic system will be replaced with new system in same area. Applicant also stated that existing
cottage will be re-built on existing footprint. COMMISSIONER JOHNSON expressed concern over wording
in the application. Applicant re-worded application to say “. . .septic system AND structure . .”. Application
amended, initialed and dated 10/21/04. COMMISSION JOHNSON also requested that narrative be re-
worded to include specific work to be performed. Applicant made such changes to the narrative, initialed and
dated 10/21/04. MOTION is as follows:

move to approve application 204 IWC 30 an application for work within the buffer to repair existing,
failing septic system for cottage and rebuild a portion of the deck on the property located at 37
Lena’s Road Montville Ct. As shown on Assessor’s Map 105 Lot 50. As depicted on the plan
entitled “Sanitary Repair Plan Zoning Location and Topographic Survey Prepared for Thomas W.
Alquist 37 Lena’s Road Montville Ct . Revision “A” Per Conditional Approval 11/11/03
Boundaries LLC P.O. Box 184 110 B River Road Route 12 Lisbon, Connecticut 06351 and
application with narrative dated 10/21/04
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void. Conditions are as follows 1) Orange construction fence be placed
around the limits of clearing area; 2) Sediment fence will be placed along the shoreline in
disturbance area; 3) House will not be increased and will be rebuilt in same location, if changes are
made to this location then the plans will have to come back before the Commission for review; and
4) If changes are made by Health District the plan will have to come back before the Commission for
review.
MOTION made by COMMISSIONER TAYLOR and SECONDED by COMMISSIONER MACFAYDEN to
GRANT license. ALL IN FAVOR. Motion Carried
7. New Business:
a. William T. Finney, Jr.: An application to construct a driveway culvert across a watercourse and through
regulated areas to access a house site on the property located at Raymond Hill Road, Uncasville, CT. As
shown on Assessor’s Map 40 Lot 1. COMMISSION reviewed application. Applicant has been requested to
provide drainage calculations to the COMMISSION. COMMISSIONER JOHNSON, STAFF and applicant
will schedule a SITE WALK. POSTPONED
b. Covenant Park, LLC: An application to construct an access road with culvert across a watercourse on the
property located at Moxley Hill Road. As shown on Assessor’s Map 9 Lot 48. Applicant not present, but told
Staff that completed Data Request Form was submitted to the State. COMMISSION will await State’s
approval. POSTPONED
c. Jill & David Marchini: An application to install a fence and landscaping within the buffer area on the
property located at 23 Andersen Lane. As shown on assessor’s Map 37 Lot 2-50. COMMISSION reviewed
application and pictures provided. COMMISSION noted that the pool itself does not extend into the buffer.
Staff stated that any material removed from holes, including soil and fieldstone, will be moved to the left side
of the property and stockpiled for use in constructing a retaining wall in that area. Applicant stated that work
will be performed in Spring 2005. MOTION is as follows:

move to approve application 204 IWC 34 An application to construct a fence, removal of fieldstone
and selective clearing of brush within the buffer area as depicted on the plans entitled” Landscape

subsequent application and narrative dated 10/05/04.
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void. Conditions are as follows: 1) 15 day period before work is performed
to allow for public comment and/or petition.
MOTION made by COMMISSIONER TAYLOR and SECONDED by COMMISSIONER JOHNSON to
GRANT license. ALL IN FAVOR. Motion Carried
d. Micah & Brianne Messer: An application for the construction of a driveway and culvert across a
watercourse on the property located at 160 Chapel Hill Road, Oakdale, CT. As shown on Assessor’s Map 28
Lot 2-01. STAFF stated that report from Town Engineer has not yet been received. Applicant also awaiting
approval from Town of New London. STAFF will visit site with applicant and bring comments and pictures
to the next meeting. POSTPONED
e. Bruce N. Valenti: An application to install a deck for a hot tub within the buffer area or the property located at 405
Maple Avenue, Uncasville, CT As shown on Assessor’s Map 31 Lot 12. STAFF provided photographs of
property. COMMISSION noted significant debris in buffer area. Applicant will be contacted to remove existing
debris before application to install deck for hot tub is granted. POSTPONED
8. Other Business: NONE
9. Minutes:
APPROVE MINUTES OF September 16, 2004 MEETING. COMMISSIONER MACFAYDEN requested minor change
in wording for clarity. Minutes amended and approved. MOTION made by COMMISSIONER TAYLOR and
SECONDED by COMMISSIONER JOHNSON. 4 IN FAVOR; COMMISSIONER MACFAYDEN ABSTAINED. Motion
Carried
