HomeMy WebLinkAbout26ZC1 ZC Evaluation Criteria Zone Change Evaluation Criteria Legal Consideration: Prior to granting a zone change request, the following items should be considered by the Commission: 1. Is the proposal in conformance with the Plan of Conservation and Development, but more importantly, is it in conformance with the intent of the Zoning Regulations (aka Comprehensive Plan) and, if not; • Non-applicable. The Government zoning is not considered in the Plan of Conservation and Development. The Town of Montville – Water Pollution Control Authority (WPCA) currently uses the property for water utility purposes and has requested this zone change. • Yes, it is in conformance with the intent of the Zoning Regulations (Section 14). 2. Was the original classification given to the land inappropriate or improper? • The current classification is R-20. The proposed classification is to apply a more appropriate classification to the parcel based on the designated and historical use as a water storge tank site. 3. Have there been major changes within the area involved which were not anticipated in the adopted Plan of Conservation and Development and Comprehensive Plan (Zoning Maps and Regulations), and which have substantially altered the basic character of the area? • No changes that were not anticipated by the Plan of Conservation and Development and Comprehensive Plan. The use for water utility purposes has altered the originally zoned used. 4. Is the proposal going to benefit the community as a whole, and not solely a particular individual or group of individuals? • Yes, the community will benefit by application of the government zoning regulations to the existing parcel. The parcel will be protected for public service and long-term municipal needs and allows for greater flexibility for public infrastructure. 5. Is the area suitable for the use and other uses permitted by right in the new zone and will the change encourage the most appropriate use of the land in the public interest? • Yes, the Water Pollution Control Authority (WPCA) water utility assets will remain in use for the benefit of the public. 6. Does the proposal represent spot zoning? • Non-applicable since the change benefits the public.
