Vlaun CC: File Date: December 5, 2019 Re: Quit Claim Deed to Mohegan Tribe of Old Fort Shantok Road and Sunny Hill Road Comments:  1. Old Fort Shantok Road has no functional use to the Town. The only issue here is whether the road should be conveyed by Quit Claim to the Tribe or abandoned. Since the Tribe is the only abutter, abandonment should not be complicated if that is the appropriate action. The Town Attorney should be consulted on this point. 2. Sunny Hill Drive does have functional use to the Town. First, Shantok Heights Road is plowed north to south due to the steep grade. The plow truck enters from Sunny Hill Road. If Sunny Hill Road is placed in Trust, the issue of Town vehicles traveling on reservation roads would have to be addressed. I have attached a 1974 plan and profile drawing which shows the two parcels conveyed to the Town which connect Shantok Heights Road and Sunny Hill Drive. Due to width and grade, it will be difficult to construct a hammerhead at the terminus. The best solution may be an agreement with the Tribe to plow Shantok Heights Road. Second, there is a sewer manhole at the intersection of the two roads. The WPCA may want to retain access to the MH because the sewer line turns west at the MH and runs down Shantok Heights Road. The same question of Quit Claim or abandonment should be referred to the Town Attorney. 3. I am not sure what the normal traffic flow is on Shantok Heights Road. The residents should be consulted regarding any specific concerns they may have.
