TERRA-LINE ENTERPRISES LLC By: Nicholas Ceccarelli, Member ��Nicholas Ceccarelli, individually THE CONDITION OF THIS OBLIGATION IS SUCH THAT: WHEREAS, the Obligors have substantially completed construction of improvements for a single family dwelling house and appurtenant facilities on property located at 356 Leffingwell Road in the Town of Montville, Connecticut (the "Property"); AND WHEREAS, there are steep slopes located on the Property that cannot be stabilized due to winter inclement weather conditions; AND WHEREAS, the Obligors have requested that the zoning official of the Town of Montville issue a Certificate of Zoning Compliance for the Property before the Property is fully stabilized; AND WHEREAS, the Town of Montville requires assurances that, when spring weather arrives, the Obligors will stabilize and vegetate the Property in accordance with the requirements of this Bond; NOW, THEREFORE, if the said Obligors shall loam and seed disturbed areas on the Property to the satisfaction of the zoning official of the Town of Montville on or before June 15, 2024, this obligation shall be null and void; Otherwise, the Obligors shall pay to the Town of Town of Montville the amount which the Town, acting by its zoning official pays to loam and seed disturbed areas of the Property in the event that the Obligors fail to complete the installation of topsoil, the planting of the disturbed areas that have been loamed with seed mixes specified by the Soil Conservation Service for the particular slopes which exist on the Property (which may be by utilization of a hydroseed mix with mastic) and stabilizing the same to prevent erosion by the installation of jute netting or similar erosion control devices, after giving written notice to the Obligors at the addresses set forth herein. To secure the performance of the work and the installation of the erosion and sediment control measures herein referred to, the undersigned hereby pledge as security therefor Passbook Savings Account No. 1 022982325 at Dime Bank in the joint names of Nicholas Ceccarelli and the Town of Montville assigning and granting unto the Town of Montville the right to withdraw and collect from said account monies and all funds which the zoning official shall require in order to complete the same as above set forth. Said account shall stand as security for the performance of the above obligations and the Obligors do hereby constitute and appoint the Town of Montville, acting through its zoning official, its true and lawful attorney irrevocable for it and in its name and stead, but to its own use and benefit, to withdraw and collect such monies from said account and for that purpose to do all things necessary or proper to accomplish the same. It is hereby agreed that the account evidencing the above said cash on deposit shall be deposited with the Treasurer of the Town of Montville as agent for the said zoning official while the Bond remains in full force and effect.
