Good afternoon Liz:
The testimony at the September 26, 2023 Planning and Zoning Commission meeting was an
accurate representation of what is being proposed. As you have previously noted, there is aninconsistency between the DEEP Demonstration Permit and the proposal that is pending
before the Planning and Zoning Commission. Our client is in the process of attempting toresolve the differing methodologies for the handling of this material with DEEP to attain
consistency with the methodologies that are contained in the municipal application. Themethodologies contained in the municipal application represent an evolution of the proposed
processes for the handling of non-hazardous dredged materials that have occurred since theoriginal Demonstration Permit was issued.

Attached please find a letter received this morning from DEEP LWRD regarding yourabove-referenced application. Besides the various recommendations listed in the
correspondence, the letter states “It appears that the Approval of Demonstration Project No.202107450 issued in January of 2022 allows the processing of the dredged materials on a
barge docked at 125 Depot Road and only allows for the storage and loading of the treatedmaterials on the property.” The application before the PZC is opposite of what the
Demonstration Approval allows and is concerning to me.
The storage of materials at the site was specifically discussed at the 9/26/23 PZC anddocumented in the meeting minutes as follows: “Director Burdick inquired about storing
amended material on site and Mr. Kovalik responded that none will be stored on site andthat well planned logistics and communication regarding shipping and trucking of materials
is important. He stated both will be determined prior to the material being brought into thesite. Director Burdick asked what would happen if weather impeded the moving of the
amended material due to the trucking restriction relative to the peak hours of the salt facilityand Attorney Heller responded that there is not an expectation of many days of extreme
winter that would affect same.”
