The July 23,2002 meeting of the Montville Planning & Zoning Commission was called to order at 7:30 pm by COMMISSIONER MAJEWSKI Present were COMMISSIONERS BARON, CLARK-WILSON, FERRANTE, MAJEWSKI, MAY, and TRYON. Absent was COMMISSIONER MARCUS. Minutes: A MOTION was made by COMMISSIONER CLARK-WILSON SECONDED by COMMISSIONER BARON to accept the minutes of the June 25, 2002 meeting. Voice vote -All voted in favor. MOTION CARRIED. MINUTES APPROVED Correspondence: New London County Soil & Water Conservation District: A letter regarding the planning of workshops for municipal officials and the general public. New Business: Agnes Sills: An application for a 3-lot subdivision at property located at 60 Hammel Lane, Uncasville, Ct. Shown on Assessor’s Map 72 Lot 24A. TABLED Zoning Issues: 7-Eleven Landscape Plan: A plan showing the landscaping details of the proposed 7-Eleven convenience store. The original plan submitted had islands totally paved with no landscaping. The COMMISSION reviewed plan and accepted the landscaping proposed. A MOTION was made by COMMISSIONER BARON SECONDED by COMMISSIONER TRYON TO AMEND AGENDA TO CONSIDER ITEMS 8a & 8b Old Business before Public Hearing ITEMS 7a – 7d. Old Business: Chestnut Ridge Associates LLC: An application for a 8-lot subdivision on property located at 143 Simpson Lane and 82 Pires Drive, Oakdale, Ct. Shown on Assessor’s Map 38, 39 Lot 50, 86. TABLED Richard Archambault: An application of a 4-lot subdivision on property located at 141 Noble Hill Road, Oakdale, Ct. Shown on Assessor’s Map 61 Lot 1. The revised plan was not received in time for review by the Town Engineer. A MOTION was made by COMMISSIONER CLARK-WILSON SECONDED by COMMISSIONER MAY to TABLE application. Voice vote -All voted in favor. MOTION CARRIED. A MOTION was made by COMMISSIONER CLARK-WILSON SECONDED by COMMISSIONER BARON TO AMEND AGENDA TO CONSIDER ITEMS 9a & 8b Other Business before Public Hearing ITEMS 7a – 7d. Other business to come before the Commission: Road Standards: A discussion of adoption of Zoning Regulations, Subdivisions Regulations and Road Standards. Public Hearing: Chestnut Ridge Associates LLC: An application for a special permit for excavation of earth product materials at property located at 143 Simpson Lane and 82 Pires Drive, Oakdale, Ct. Shown on Assessor’s Map 38, 39 Lot 50, 86. WITHDRAWN Timothy Brennan: An application for a special permit to construct a two-family dwelling house in an R20 zoning district on property located at 1311 Norwich-New London Turnpike, Uncasville, CT Shown on Assessor’s Map 88 Lot 24. Staff made a presentation to the COMMISSION. DOT still has outstanding comments which the COMMISSION felt were not relavant. There was no public comment in favor or against this application. A MOTION by COMMISSIONER CLARK-WILSON SECOND by COMMISSIONER BARON to close the Public Hearing. Voice Vote - All voted in favor. PUBLIC HEARING CLOSED Joe Summers: An application for a proposed 38 child daycare center on property located at 1127 Old Colchester Road, Oakdale, CT. Shown on Assessor’s Map 37 Lot 2-84. A MOTION was made by COMMISSIONER CLARK-WILSON SECONDED by COMMISSIONER MAY to TABLE application. Voice vote -All voted in favor. MOTION CARRIED Wayne Bartling: An application for a zone change from R20 to C1 on property located at 1536 & 1552 Route 32, Uncasville, Ct. Shown on Assessor’s Map 91 Lots 9 & 10. Wayne Bartling made a presentation to the COMMISSION. He submitted into public record a handout of his presentation (exhibit A). STAFF made a presentation to the COMMISSION showing the existing zoning in the area and explained the provisions of Section 4.2.2.1 for properties with frontage located on Route 32 (Norwich-New London Turnpike). STAFF stated the application did not meet the criteria for a zone change. Public Comment: IN FAVOR: Wayne Bartling – 9 Fowler Avenue, Norwich, Ct 06360 Mr. Bartling feels that the proposed zone change will not change the type of activity currently occurring on the property. He feels it would be in the best interest of the residents to have this change granted. Alfred Drozdel – 1552 Route 32, Uncasville, Ct 06382 Mr. Drozdel is in favor of the application. He stated he believes this is a good option for this property. NO PUBLIC COMMENT AGAINST THE APPLICATION. A MOTION by COMMISSIONER CLARK-WILSON SECOND by COMMISSIONER TRYON to close the Public Hearing. Voice Vote - All voted in favor. PUBLIC HEARING CLOSED Other business to come before the Commission: Timothy Brennan: An application for a special permit to construct a two-family dwelling house in an R20 zoning district on property located at 1311 Norwich-New London Turnpike, Uncasville, CT Shown on Assessor’s Map 88 Lot 24. A MOTION was made by COMMISSIONER CLARK-WILSON SECONDED by COMMISSIONER TRYON to APPROVE application with conditions. Roll Call vote - All voted in favor. MOTION CARRIED. The well be removed from the revised plan dated 6/25/02 Comment #4 on plan be revised to state “sewer connection and construction be in accordance with WPCA regulations” Additional note to be added to plan regarding the sewer easement Zoning permit will not be issued until the required DOT permits have been received by applicant. Adjourn: A MOTION by COMMISSIONER BARON SECOND by COMMISSIONER TRYON to adjourn. All voted in favor. Meeting adjourned at 9:05 pm.
