EXISTING CONDITIONS: The site is developed with an existing telecommunications tower and
equipment structure; which use is permitted in the R-40 zone.
REVISED PROPOSAL: Accessory office building and associated site improvements for existing use
of the property for a telecommunications tower. Applicant states “Breezeline has agreed to
downsize the proposed building and site development program. This downsized program is
depicted in detail on the revised plans. Highlights are as follows: 912 sq.ft. building now
proposed (38 ft x 24 ft, a 25% floor area reduction); 4 parking spaces with reduced impervious
area [additional gravel parking that is available around the existing building is not specifically
shown]; the stormwater basin has been downsized accordingly (with outlet clearly directed
away from the neighbor to the south); The septic will not need to be upsized (refer to Uncas
Health District comments); Only one site light pole is now provided; Walkway is still handicap
accessible to both doors, but now reoriented to accommodate the relocated accessible
parking space (please see response to Building Official below); and everything is moved further
from the neighbor to the south. Even so, additional screening trees have been added along
that property line.”

INLAND WETLANDS COMMISSION: N/A.
UNCAS HEALTH DISTRICT: See comments dated 2/23/23. Michael Kirby, R.S. states, “Any
utility trench backfilled with free-draining material, e.g. sand or gravel, must be a
minimum of 25 feet from any part of the septic system.” Condition of approval.
STATE OF CT DEPT. OF HEALTH: N/A.
TOWN ENGINEER: See comments dated 2/20/23. Outstanding: The painted symbol in the
handicap space must match that on the sign.” Condition of approval.
BUILDING DEPT.: See comments dated 2/2/23. All comments addressed.
FIRE MARSHAL: See comments dated 01/20/23 regarding emergency lights, exit signs &
fire alarms. Condition of approval.
STCT DOT: N/A.
BOND: A soil erosion and sediment control bond estimate in the amount of $8,150 has
been reviewed and approved by the Town Engineer in his comments dated 2/20/23.
STAFF COMMENTS: Please be advised of the following comments regarding my review of
the application, supporting documentation and plan set entitled “Site Plan, Breezeline
Uncasville, CT, Tax Map 30, Map 89, Lot 00-A, 689 Old Colchester Road, Uncasville, CT,
Prepared for Atlantic Broadband CT LLC (Breezeline), Prepared by Civil Works, New
England & North by Northeast, Dated January 10, 2023, Revised to February 13, 2023”:
1. The project has been be scaled back so as to represent an accessory use. I have
no further comments.
STAFF RECOMMENDATION: APPROVE WITH CONDITIONS.
THE FOLLOWING MOTION IS SUGGESTED FOR ANY FAVORABLE APPROVAL:
“I make a MOTION to APPROVE Application #23 SITE1- 689 Old Colchester Rd (Parcel ID
030/089/00A), Uncasville, CT, Applicant/Owner: Atlantic Broadband (CT), LLC for site plan
approval for an accessory office building and associated site improvements in that the
application, supporting documents and a plan entitled “Site Plan, Breezeline Uncasville,
CT, Tax Map 30, Map 89, Lot 00-A, 689 Old Colchester Road, Uncasville, CT, Prepared for
Atlantic Broadband CT LLC (Breezeline), Prepared by Civil Works, New England & North
by Northeast, Dated January 10, 2023, Revised to February 13, 2023” comply with all
applicable sections of the Montville Zoning Regulations, with the following conditions:
1. Applicant shall meet all of the requirements of the Montville Building Department,
Office of the Fire Marshal, Uncas Health District for required permitting and inspections.
2. The painted symbol in the handicap space must match that on the sign.
3. All drainage structures proposed for the project shall be constructed and
maintained post construction in accordance with the approved Plan Set & Stormwater
Management Report, dated January 10, 2023, Revised to February 13, 2023.
4. Prior to issuance of a zoning permit to start work, a soil erosion & sediment control
bond shall be posted in the amount of $8,150 in a form acceptable to the Finance
Director
5. Final revised plan sets, along with a digital copy of the final plan, shall be
submitted to the Land Use Dept. & shall be signed and sealed with original (wet)
signatures by P.E. & L.S
6. An approved Zoning Permit is required prior to the start of any work.
7. The ZEO must be contacted and a pre-construction meeting shall be held at least
24- hours prior to start of any work. Soil Erosion and Sediment Controls shall be installed in

accordance with the approved plan set and inspected by the ZEO prior to the start of
any work.
8. After work has commenced, any substantive changes to the approved site plan
require review and approval by the Land Use Director and/or the Planning & Zoning
Commission.

eight (8) transient employees. A 10-space parking lot is proposed to provide on-site
parking for those employees along with an on-site stormwater management system and
other appurtenances.”
INLAND WETLANDS COMMISSION: N/A.
UNCAS HEALTH DISTRICT: Referred on 1/12/23. UHD comments dated 1/18/23 state no
application had been submitted to it. Applicant submitted application to UHD same
day. Comments pending.

1. A proposed office building clearly accessory to the existing unmanned
telecommunications facility is permitted. Office buildings are not permitted in the R-40
zone.
It is my opinion that the proposed use of an office building for 2 full-time & 8 transient
employees, a 10-car parking lot with 4 EV charging stations and 4-20 vehicle trips per day
does not support an accessory use. Subsequently, it is my opinion that your application
cannot be approved as the proposed office use is not permitted in the R-40 zone.
2. Staff recommends the project be scaled back to represent an accessory use.
STAFF RECOMMENDATION:
1. Applicant/Owner should request the application be tabled to the February 28,
2023 regular meeting to allow for time to revise plans to meet Town staff comments.
