REGULAR MEETING MINUTES
THURSDAY, AUGUST 16, 2018 – 7:00 P.M.
LOCATION: MONTVILLE TOWN HALL, Council Chamber

1. CALL TO ORDER
Chairman Brush called the meeting to order at 7:00.
2. ROLL CALL
Present: Chairman-Doug Brush, Vice-Chairman Charles O’Bday III, Secretary Philip Houk,
Commissioner Jessica LeClair, Sandra Berardy
Absent: Commissioners Anthony Tufares, Full Vacancy, Alt. Vacancy, Alt. Vacancy
Attending: none
3. MINUTES: Approve the Minutes of the July 19, 2018 Regular Meeting.
MOTION: (LeClair/O’Bday) to approve the July 19, 2018 minutes as presented.
Vote: Approved. In favor-Brush, O’Bday, Houk, LeClair. Opposed-none. Abstaining-
Berardy

6. REMARKS FROM THE PUBLIC (not relating to items on the agenda)
Adam McNiece, 1446 Rte. 85, stated he is filing a complaint of violation of the CT
Public Health Code against Lombardi Construction. He stated there are a number
of state and local violations. He informed the Commission his well has dried out
and the lack of water is killing his trees due to Lombardi diverting water from his
property. A. McNiece stated the permitting was not conducted correctly.
Chairman Brush stated he would investigate all the issues A. McNiece presented.

8. NEW BUSINESS
A. 2181IWC14-Lake Drive (Map 108 Lot 104) Applicant /Owner Oxoboxo
Beach and Boat Club, Inc. - Repair of existing boat launch and placement
of riprap within the review area.

Chris Page, President of the Oxoboxo Beach and Boat Club stated the club
is proposing minor work to the existing boat launch. The applicant is
requesting a permit to reposition concrete boat ramp rails by hand, to
install 4-7 inches of riprap between the rails and on the outer edge of the
rails to approximately 1.5 Ft. No stockpiles of riprap will be needed as it
will be taken off the landscape trailer. The club would like to take
advantage of the lake being lowered after Labor Day. The boat launch will
be out of the water making it easier to do repairs.
MOTION: (Berardy/O’Bday) to table application 2181IWC14-Lake Drive
until the September 20, 2018 meeting. Vote: Approved Unanimously.
B. 218IWC15-Leffingwell Road, Noble Hill Rd, Trading Cove Brook, Applicant
Norwich Public utilities (NPU) to extend existing water transmission main
through portion of Montville.
Darren Haywood, and Bob Russo of CLA Engineers presented for the
applicant. Due to construction of a large development in Bozrah, NPU has
to reroute a water transmission main. They are proposing to install a 24”
ductile iron water main, connecting to existing water transmission main
from Stony Brook Reservoir in Montville to Rte. 82 via Leffingwell Rd.,
Noble Hill rd., and crossing Trading Cove Brook. Pilings for the steel
support structure will be installed in the upland review. The proposed work
does not include any filling or grading within the wetlands and will not
introduce any new water into the wetlands.
The majority of the work will be in the right of way which was previously
disturbed. The supporting structure will be a galvanized steel truss system
on concrete. The water main will approach Trading Cove Brook
underground and will come up and go across the river by way of a 24”
diameter pipe and then back underground on the opposite side of the
stream. The area is heavily vegetated and any disturbed areas will grow
back naturally.
The applicant is in the process of filing for a flood management permit
from DEEP and a permit from Bozrah Inland Wetlands Commission.
The applicant will add elevations to the plan.
It was the consensus of the Commission to conduct a site walk on
September 18th at 5:00 at the Trading Cove Brook site.

Road, Noble Hill Rd, Trading Cove Brook until the September 20, 2018
meeting. Vote: Approved Unanimously.

9. Correspondence
ZEO, N. Woodlock informed the members of the DEEP Wetlands and
Forestry presentation and workshop. She stated that the DEEP wetlands
courses will be offered online in the near future.
10. Other Business:
Chairman Brush stated he will be researching the complaint presented
during Public Comment and in the future if there are legal concerns
involving the Commission he should be made aware of the issue.
