Activity Description: Wetland Disturbance Area 270 SF Watercourse/Waterbody Disturbance Area 0 SF Upland Review Disturbance Area 2,100 SF STAFF COMMENTS:  The site is located on 6.774 acres (295075 SF) in the R-120 zoning district with about 339-feet of frontage on Fire Street. The site is currently being developed for a single- family residence and associated site improvements outside of regulated areas.  In order to access the proposed building site on the property, the Applicant drove an excavator in regulated upland & wetlands areas. In doing so, the tracks on the excavator disturbed surface soil, both in 2,100SF of upland review area and 270ST of wetland area.  On March 14, 2022, I inspected the property and reported that wetlands had been disturbed. Planning Director, Liz Burdick, along with Attorney Harry Heller and property owner Kyle Champagne conducted a site inspection during which Mr. Champagne agreed to stop all work, have the wetlands delineated & mapped and submit a remediation plan for approval by the IWC to permit the work. SIGNIFICANT IMPACT: Where uses/proposals are determined to meet the criteria of a significant impact as defined in the Regulations, a public hearing must be scheduled by the IWC. A permit may be issued without a hearing following the petition period 14 days after receipt of application, subsequently action on the application needs to be tabled to the May 17, 2022 meeting. STAFF RECOMMENDATION: Staff recommends the IWC receive & review Application 22 IWC 7, set a date for a site walk, if desired, and table the application to the May 17, 2022 meeting.
