STAFF COMMENTS:
Applicant is requesting a favorable report to the Montville Planning & Zoning
Commission (PZC) in accordance with CT General Statutes (CGS) Section 8-26
(Applications involving an inland wetland or watercourse), Montville Subdivision
Regulations Section 3.5 (Wetlands Agency Referral), and CGS Chapter 440, Sections
22a-28 to 22a-45d (Wetlands and Watercourses) for a 1-lot resubdivision containing
regulated upland & wetlands and watercourses areas, but no proposed regulated
activities..
The property to be subdivided shown as Lot 50-006 on a subdivision plan entitled
“Subdivision Plan, Prepared for Chestnut Ridge, LLC, #143 Simpson Lane, Oakdale, CT,
by CLA Engineers, Dated Oct. 2003, Revised 12/12/03” approved by Montville PZC on
12/9/2003 following a favorable report from the IWC on 10/16/2003 and filed on the
Land Records in the office of the Montville Town Clerk as Drawing Number 1983.
The site consists of 14.74 acres (642,074SF) located in the R-40 zoning district with
about 154-feet of frontage on Simpson Lane and contains about 2.5-acres (108,900SF) of
delineated wetlands/waterbodies.
The Applicant is proposing a 1-lot resubdivision that will create two lots ranging in size
from 6.31-acres (274,864SF) to 8.43-acres (367,211SF) to be developed for new single-
family residences with on-site septics & wells and associated site improvements. The lots
will be accessed from a common driveway from Pires Drive. No regulated activities are
proposed as part of the resubdivision.

CONSIDERATIONS FOR ACTION:
If the Commission is inclined to send a favorable report for this 1-Lot Resubdivision application
to the PZC, the following language for a motion of approval is suggested:
M O T I O N # 1 (A Motion to Approve)
After giving due consideration to all relevant factors, including those in the CT General Statutes
(CGS) Section 8-26 (Applications involving an inland wetland or watercourse), Montville
Subdivision Regulations Section 3.5 (Wetlands Agency Referral), and CGS Chapter 440,
Sections 22a-28 to 22a-45d (Wetlands and Watercourses), I move that the Commission forward a
favorable report to the Montville Planning & Zoning Commission for Application #22 IWC 6,
submitted by the Applicant/Owner, Chestnut Ridge, LLC for a 1- Lot Re-subdivision of 82B
Pires Drive as more fully described in the application & supporting documents, dated 3/28/2022
and a plan entitled “Resubdivision Plan, Prepared for Chestnut Ridge, LLC, #82B Pires Drive &
Simpson Lane, Montville, Connecticut, Prepared by Advanced Surveys, LLC, Dated February
08, 2022” due to no regulated activities.
