Applicant Request: After-the-fact application to authorize activities within regulated uplands
and wetland areas associated with the relocation of shed and installation of walking bridge
accessory to a single-family residence.

Staff Comments:
The site is located on 17.94 acres with approximately 2.38 acres in the R-40 zoning district and
approximately 15.2 acres in the R-80 zoning districts with about 161 feet of frontage on Pruett Place.
The site is currently developed with single-family residence and the home owner is in the process of
constructing a barn. When applying for the zoning permit for the barn, they received the attached letter
from Soil Scientist Mark H. Sullivan, L.S. dated January 5, 2022.
I received a complaint about a shed being relocated and a wetlands crossing being installed at the
property. I spoke to Steve and Lori Middel on August 2, 2022 and they stated that they did move the
shed which sits on crushed stone and no excavation of the property was done. They also stated that
there is a small bridge that sits on the ground with no dug footings which crosses an intermittent stream
to connect an old cart path. They were unaware of the need for a permit from this commission to do
this work.
On September 1, 2022 I did a site inspection at which time the applicant showed me the previous
location of the shed and stated Carefree Buildings had relocated it to the new location. The shed is
located on a maintained lawn as can be seen in my inspection report dated September 1, 2022. There is
an intermittent stream approximately 20 feet from the rear of the shed.
He also showed me a wood storage structure that was there prior to him and his wife purchasing the
property. That structure is located to the northwest of the new shed location.
During my September 1, 2022, the applicant also showed me the walking bridge which he stated he
constructed to keep foot traffic out of the intermittent stream.
Significant Impact
Where uses/proposals are determined to meet the criteria of a significant impact as defined in the Regulations, a
public hearing must be scheduled by the IWC. A permit may be issued without a hearing following the petition
period 14 days after receipt of application, subsequently action on the application needs to be tabled to the
October 20, 2022 meeting.
Staff Recommendation: Staff recommends the IWC receive & review Application 22 IWC 19, set a date for a site walk if desired and table the application to the October 20, 2022 meeting.
