Johnson Address: 7 Fielding Drive (MLB 087-016-000) Submitted: August 4, 2022 Date Received by IWC: August 18, 2022 (DRD – 10/22/2022) Applicant Request: After-the-fact application to authorize activities within regulated uplands and wetland areas associated with constructing a bridge, cutting and removal of trees and removal of rocks from intermittent stream in conjunction with single-family residence. Activity Description: Wetland Disturbance Area 0 sqft Watercourse/Waterbody Disturbance Area Approximately 10 LF Upland Review Disturbance Area Approximately 10 +/- sqft Staff Comments: The site is located on 0.51-acre in the R-40 zoning district with about 131 feet of frontage on Fielding Drive. The site is currently developed with single-family residence. On August 4, 2022, I inspected the property for a wetlands complaint. I met with the property owner who showed me the intermittent stream, a recently constructed bridge and trees that were recently cut down with stumps still remaining. He stated he was unaware that a permit was needed prior to conducting work. The applicant has constructed a 4’ x 12’ bridge across the intermittent stream which replaced a 2 x 12 plank that was there prior to him purchasing the home. He stated that the bridge is on 4 x 4’s that rest on the ground, no footings were dug. The applicant has cut down several trees at the request of the solar company which currently are across the intermittent stream and one on the bank and in the stream which was dry at the time of my inspection. The applicant would like to remove these trees which will require them being cut into several pieces to be able to move them. The applicant also stated that he has removed some rocks from the bottom of the stream so his children can splash around when the stream is flowing. He states that the stream continues to flow when we are not in a drought. Significant Impact Where uses/proposals are determined to meet the criteria of a significant impact as defined in the Regulations, a public hearing must be scheduled by the IWC. A permit may be issued without a hearing following the petition period 14 days after receipt of application, subsequently action on the application needs to be tabled to the September 15, 2022 meeting. Staff Recommendation: Staff recommends the IWC receive & review Application 22 IWC 16, set a date for a site walk if desired and table the application to the September 15, 2022 meeting.
