FEB 15 PM 3: 3 PLANNING & ZONING COMMISSION310 NORWICH NEW LONDON TPK&J^. >>QUNCASVILLE, CT. 06382 TOWN CLERK PHONE (860) 848-8549 Fax (860) 848-2354 MINUTES FEBRUARY 13,2001 The February 13, 2001 meeting of the Montville Planning & Zoning Commission was called to order at 7:30 P.M. by COMMISSIONER MAJEWSKI. Present were COMMISSIONERS CHARLAND, MARCUS, TINNEL, FERRANTE, MAJEWSKI, COGGESHALL, and ALTERNATE BARON. Absent were COMMISSIONERS BELLAMY, SINGER and ALTERNATE SHEFLOTT. ALTERNATE BARON sat in for COMMISSIONER SINGER. 3. Minutes: A MOTION by COMMISSIONER TINNEL SECOND by COMMISSIONER CHARLAND to accept the minutes of January 23, 2001. All voted in favor. MOTION CARRIED. 4. Correspondence: a) Seminar on Connecticut Land Use Law for Municipal Land Use Agencies, Boards and Commissions at Wesleyan University on Saturday March 3, 2001. b) Town of East Lyme: Proposed Zoning Amendment Section 8.3.5 Height. c) Connecticut Siting Council - Docket Number 201: Mohegan Tribal Utility Authority application for a Certificate of Environmental Compatibility and Public Need for the construction maintenance and operation of a 115 kV electric substation located west of an existing 115 kV transmission line right-of-way, north of Woodland Drive, and east of Interstate Route 392, in Montville, Connecticut. 625 5. New Business: a. Virginia Holloway, Edward Wilcox, Michael Chopp: An application for a Zone Change on property located at 568 Route 163, Montville, Ct Shown on Assessor's Map 30 Lot 31. (Current Zone R-120 - Proposed Zone R-20). A MOTION by COMMISSIONER TINNEL SECOND by COMMISSIONER CHARLAND to schedule a PUBLIC HEARING for March 13, 2001. All voted in favor. MOTION CARRIED. PUBLIC HEARING SCHEDULED. b. 8-24 Review: An Application for an 8-24 Review for the American Legion Building on property located at 241 Maple Avenue. Shown on Assessor's Map 82 Lot 86. A MOTION by COMMISSIONER CHARLAND SECOND by COMMISSIONER TINNEL to TABLE. All voted in favor. MOTION CARRIED. APPLICATION TABLED. c. John Lahaniatis: An application for a day care center for 12 or more on property located at 28 Sandy Desert Road, Montville, Ct. Sown on Assessor's Map 56 Lot. 5. A MOTION by COMMISSIONER TINNEL SECOND by COMMISSIONER CHARLAND to TABLE to February 27, 2001. All voted in favor. MOTION CARRIED. APPLICATION TABLED. d. Tilcon Connecticut, Inc.: An application for renewal and extension of a Special Permit for the excavation, processing and sale of earth products on its property located at 53 Caroline Road, Montville, Ct. Shown on Assessor's Map 59 Lot 7. A MOTION BY COMMISSIONER TINNEL SECOND by COMMISSIONER CHARLAND to schedule a PUBLIC HEARING for March 13, 2001. All voted in favor. MOTION CARRIED. PUBLIC HEARING SCHEDULED. 626 6. Zoning Issues: a) David Spurgas: An application for a home occupation on property located at 4 Birch Point Trail, Montville, Ct. Shown on Assessor's Map 108 Lot 96. The Commission explained to Mr. Spurgas that parking his oil truck at his residence was a violation of the original Home Occupation Permit he was issued. The original permit was for a home office and it clearly stated no trucks, signs, etc would be at the residence. Mr. Spurgas explained he did not realize he was creating a problem for his neighbors. The reason he brought the truck home during the cold months is that he is on call 24 hours a day, and the truck, being diesel, has to be plugged in or it won't start. He has garaged his truck at Gardner Lake Fire Station since receiving the Cease and Desist Order on January 25, 2001. He stated he would not bring the truck to his residence again and that his main office was in Norwich. COMMISSIONER MAJEWSKI questioned why he needed the Home Occupation Permit if the office is in Norwich. Mr. Spurgas stated he gets calls at home and since his is a 24 hour a day operation, he has to be available. COMMISSIONER MAJEWSKI explained that since answering the telephone did not require a Home Occupation Permit, and the main office is not in the home, he did not see the need for a permit. Mr. Spurgas withdrew his request for a Home Occupation Application. A MOTION by COMMISSIONER CHARLAND SECOND by COMMISSIONER MARCUS to keep the Cease and Desist order in place. COMMISSIONER TINNEL abstained from voting. All others voted in favor. MOTION CARRIED. CEASE AND DESIST ORDER WILL REMAIN IN PLACE. 7. Public Hearings: 8. Old Business: a) COMMISSIONER TINNEL reported the renovation of the Uncasville School were progressing nicely. The windows have been installed, a new roof will be put on the building, the elevator shaft is in and the foundation for the new vault has been laid. 9. Other business to come before the Commission: 627 10. Adjourn: A MOTION by COMMISSIONER TINNEL SECOND by COMMISSIONER CHARLAND to adjourn. Meeting adjourned at 8:00 P.M.
