I have received your review comments with respect to the Chestnut Ridge Resubdivision.Please note the following: 1. I will forward under separate cover the Third Amendment to the Declaration of Chestnut Ridge which will add the new lot. The "common areas" as shown on the plan from 2003 areestablished by the original Declaration. Those portions of the common areas which are incorporated into the lot being resubdivided remain bound by the terms and provisions of theDeclaration. 2. With respect to Comment 2, please note that there is no common driveway easement and maintenance agreement. Chestnut Ridge is a common interest community under theConnecticut Common Interest Ownership Act, C.G.S.Section 47-200 et. seq., the easements created in the Declaration of Chestnut Ridge, recorded in Volume 444, Page 691 of theMontville Land Records provide easement rights to all lot owners, including lot owners of lots created pursuant to development rights in the Declaration. The cost of maintenance of thecommon driveway is a common expense and is paid by the unit owners in their common charges pursuant to the Declaration. 3. With respect to Comment 6, please note that the soils on both lots are free draining soils;and, therefore, pursuant to the provisions of the Connecticut Building Code, no footing drains are required. 4. I have forwarded your remaining comments to the applicant's surveyor to address.
