Applicant Request: Regulated activity for a driveway within upland review area associated with a new
single-family residence.
Activity Description:
Wetland Disturbance Area 0 SF
Watercourse/Waterbody Disturbance Area 0 LF
Upland Review Disturbance Area 1,200 SF +/-
Staff Comments in Review: Application is for an as-built driveway located in an upland review area and
was reviewed by the IWC at its 2/17/22 meeting. The Commission did not make a finding of significant
impact activity, subsequently no public hearing was required.
Subsequent to the 2/17/22 meeting, further activity was observed in mapped regulated areas. A site
inspection by staff with the applicant and Atty. Harry Heller was conducted on 3/16/22. The disturbed soils
did not necessarily appear to be wetlands soils. It was determined that wetlands have not been verified since
about 1992. Applicant is having wetlands re-delineated and, based on said delineation, a plan will be put in
place to restore the disturbed area. Further activity is prohibited at this time.
Staff made a determination of possible violation and forwarded same to the Applicant & Atty. Heller via
email (copy attached). This violation will be addressed separately from this application. Should additional
IWC approvals be required, a new application will be necessary.
Staff Recommendation: Approve with condition.

After giving due consideration to all relevant factors of the Montville Inland Wetland Regulations,
including those in Section 6 (Regulated Activities to be Licensed), Section 10.2 (Criteria for Decision)
& Section 22a-41 of the Connecticut General Statutes, I move to APPROVE Application #22 IWC 1 –
Owner/Applicant: Kyle Champagne for regulated activity for a driveway within an upland review area
at 631 Fire St., Oakdale, CT per the application & associated documents dated 2/10/2022 and as shown
on a plan entitled “Septic System Design Plan Prepared for Kyle C. Champagne, 631 Fire Street,
Montville, Connecticut, prepared by Advanced Surveys, LLC., Dated January 24, 2022 Rev. February
22, 2022” with the condition that any further activity in regulated areas requires review and approval
prior to the start of any work.
