Inspection Report
Date: 9-4-08
Location: 1494 Old Colchester Rd
Purpose of Inspection: Complaint by neighbor of activity within
wetland area

Mrs. Linskens filed a complaint with the office on 8/20/08. She
indicated that her neighbor had been doing some work within the
wetland area. She provided pictures of the area in question. Her
concerns were that they were burying pipe and dumping into the wetland area.
An initial inquiry letter was sent to the Giel’s on August 26, 2008. Mrs. Giel called the office the beginning of the following week and
an inspection time was scheduled.
Staff went to the property on September 4, 2008 and met with Mr.
Giel and their son. He explained that the activity shown in the
pictures was the removal of old soil stockpiles. Since they have
purchased the property they have been in the process of cleaning
up debris. This includes the removal of the stockpiles. Staff
explained that the stockpiles were within a wetland area. After
discussion regarding other projects they had planned for the
property, Staff indicated that a wetlands permit and or
determination from the Commission would be required.

At this time, the activity in question is not to be considered a
violation. The pipe material that was seen was actually buried in
and under the piles of soil. There is no intent to use the concrete
pilings, instead they will be removed off the property. However
the activity will require a wetlands permit and the Giel’s were given an application package to fill out and provide to staff prior to
the next Inland Wetlands meeting.
Discussion was held regarding future activity on the property.
Staff indicated that any future activity could be put in the permit for the Commission to review.
