A complaint form was submitted to the office with pictures showing the dumping of sand
on the property located at 35 Lena Rd. In addition another picture was submitted showing
the property owner with a wheel barrel down by the water with a possible rake. The
property owners had been told that if they wanted to add more sand to their beach they
would have to come in for an additional permit. A Cease and Desist Order was issued.

Dear Mr. & Mrs. Chester:
At this time you are being issued a Cease and Desist Order for the activity taking place on 35 & 35A Lena
Rd (Assessor’s Map 105 Lot 51 & 52) You are so ordered based on the following facts:
1) The Town of Montville Inland Wetlands Commission has the authority and responsibility to
regulate inland wetlands and watercourses within the Town of Montville under section 22a-36
through 22a-45 of the Connecticut General Statutes and the Inland Wetlands and
Watercourses Regulations of the Town of Montville.
2) It has been determined that you or your agents have been conducting regulated activities
without a permit including but not limited to: depositing of material within a regulated are.
3) These activities have occurred without the required permit (Section 22a-42a, Connecticut
General Statutes and Sections 6.1, 6.1.1, and 6.2 of the Town of Montville Inland Wetlands
and Watercourses Regulations) and constitute a violation of the law, contrary to the public
policy set forth on Section 22a-36, Connecticut General Statutes.
This order is issued in accordance with Section 22a-44 of the Connecticut General Statutes and Section
13.3 of the Town of Montville Inland Wetlands and Watercourses Regulations.
Failure to comply with the provisions of this order will subject you to the penalties provided in Section
22a-44 of the Connecticut General Statutes.
This matter will be brought up at the September 15, 2011 meeting of the Inland Wetlands Commission at
7:00 pm in the Town Hall Council Chambers, Montville Town Hall 310 Norwich New London Tpke
