Background Information
This project was started in the late 1960’s, problems started immediately due to septic problems.
Properties were foreclosed on and then sold at a Tax sale in the 1970’s.
SEE ATTORNEY DEVINE’S LETTER OF 10/20/94 FOR EXPLANATION.
In 1994 after sewers became available, Subdivision and Special Permit applications were
requested. The Zoning Board of Appeals granted setback and lot area variances.
12/13/94 Subdivision and Special Permit approval was granted. Sewers had been installed;
however, water was still not available. The approval was granted with the use of on site wells.
12/13/99 The Special Permits expired with no significant activity having taken place.
Early 2005 started to repair structures after citations from Building Dept. Applied for permits
for roof, doors, windows & siding for the structures.

Analysis
The Zoning Regulations Section 17.9.1 requires Public Sewer & Water Supply for Multi-Family
dwellings. The regulations do not provide for a waiver of this requirement. The original approval
granted in 1994 allowed for individual wells for each structure. At that time public water was not
available to the properties. With the recent installation of the Route 32 water line a Public Water
supply is now available to the property. Water has been installed in Platoz Drive and is 500 +/-
feet from the property.
The applications do not meet the requirements of Section 17 of the regulations.
Although a Special Permit was approved in 1994 minimal activity has taken place until the recent
building code violation.
Permit has been expired for over six years.
These are new applications with new legal ownership. Title has transferred within the last six
months.
Fire Marshal Comments in regards to fire protection have not been adequately addressed.
Traffic Analysis
Platoz Drive is of adequate size to handle the traffic from these Multi-Family dwellings.

Deny the Special Permit Applications.

Reason: Failure to meet the requirements of Section 17.9. Particularly Section 17.9.1 the site shall
be served by public water.
