1. Previous application was withdrawn
2. New plan proposes a combined driveway for the (2) duplexes
3. There is no wetlands activity on the site
4. There is work within a wetland area in conjunction with the drainage that is needed for the project
5. The drainage on Fielding Drive is in need of repair. Montville Public works has indicated that they
will work in conjunction with the applicant to improve the draingae for the area
6. The work within the wetland includes rip rap structures
7.A grading easement is needed
8. Plans and or easement information has been sent to the following

of the Montville Inland Wetland Regulation and Section 22a-41 of the Connecticut General Statutes,
I move to approve application
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void.

1. Commission scheduled Public Hearing due to significant public interest
2. Original Application was granted on January 29, 2004
3. During October of 2005 there was significant rainfall in the area which caused a portion of the
North slope wall to fail.
4. After review of the site the DEP made the determination that the detention basin, as constructed,
required a dam permit and they would have jurisdiction over the site
5. The basin was ordered to be pumped, to reduce the amount of stormwater in the basins, into the
adjacent wetland system
6. The applicant has determined that impact caused by the existing basin can be mitigated by creating
a "cut detention basin"
7. The redesigned basin location is in the same footprint area as originally proposed except for a new
emergency spillway
8. Other new activities proposed are
1. Piping of stormwater from the "cut basin" to an interconnection with a 42 inch
reinforced concrete pipe culvert which carries stormwater under Podurgiel Ln.
Interconnections to this outfall will also be made to the existing underdrain for the
North Slope and to a new catch basin
2. Since easements were not able to be obtained by the Town, a plunge pool inlet will
be constructed at the northwesterly corner of the site

1. Property was recently subdivided and the subdivision map has been used for wetland delineation
2. The property has two small sets of wetlands
3. The logging road and skid trails are outside of the regulated areas.
4. In light of recent timber harvest problems staff suggested that the applicant show the Commission
the location of the drive in relation to the wetlands.
5. Staff at this time has no concerns with the project as proposed
6. The applicant has agreed to place orange construction fence at the buffer line

7. Construction was done with a small backhoe and blocks were placed by hand - no mortar was used
