Applicant Request: Modification of Permit# 213IWC18 for regulated activities in conjunction
with adaptive reuse of mill buildings for multi-family residential.
Activity Description:

Watercourse/Waterbody Disturbance Area 60 LF
Upland Review Disturbance Area 33,100 SF
STAFF COMMENTS:
In review:
- Application is for a Modification of Inland Wetlands Permit# 213IWC18 for regulated
activities in conjunction with adaptive reuse of mill buildings for multi-family residential.
- The site is located on 10.64 acres in the R-20-M zone and contains existing mill buildings
of Faria Beede Instruments and associated parking.
- BSC Group completed on-site investigation to review wetlands and watercourses
boundaries on the site by a qualified staff wetland/soil scientist on August 23, 2016. A copy of
said wetland investigation is attached to the application.
- A Regulated Area Comparison of the 2013 Application versus the 2016 Application has
been provided and shows a total area disturbed of 35,700SF versus 50,000SF in 2013.
- The project overview submitted as part of the application describes the proposed activities
in Area Designations RA-1 to RA-9 as follows: RA-1: Clear debris and vegetation (inc. invasives)
& place pedestrian path (Upland Review Area); RA-2: Construct walking paths, children’s play
area and improved storm water treatment facility (Upland Review Area); RA-3: Clear invasives
adjacent to building and plant with wildflower mix (Upland Review Area) ; RA-4: Clear vegetation
(inc. invasives) and plant with wildflower mix (Upland Review Area); RA-5: Limited disturbance
in brook to place helical piles to support scour at building foundation (Temporary Watercourse
Disturbance); RA-6: Portion of bituminous basketball area (Upland Review Area) ; RA-7:
Selective invasives removal (Wetlands & Upland Review Area Enhancement) ; RA-8: Construct
new drainage facilities to replace undersize swale (Upland Review Area) ; and RA-9: Construction
of new drainage pipe (Upland Review Area). A copy of said project overview is attached to the
application.

- Additionally provided in the project overview are Erosion Control Procedures,
Construction Sequencing and Alternatives. It is anticipated the construction will commence
approximately the summer of 2017 and proceed for approximately 10 months. Alternatives to
the proposed residential project include: 1. Complete demolition of the entire site, including
the existing buildings and infrastructure, and complete redevelopment with a different
footprint; and 2. No development. The Applicant states “the current proposal seeks to
develop the site in a manner that not only has the least impact possible, but greatly enhances
the environmental quality of the site. The existing footprints will be maintained (save for two
outbuildings that will be demolished), the site paved parking areas are proposed in locations of
existing paved areas, stormwater facilities will be greatly enhanced, and rubbish and invasive
species will be removed from the regulated areas and replaced with native plantings and wildflower
mix.”
- The activities have been reviewed & approved by the Town Soil Scientist and the proposal
reviewed by the Town Engineer, whose requested plan revisions will not impact the regulated
activities at the site.
- The Applicant has submitted a construction detail for the “Foundation Support Adjacent
Block” (helical piles) and the silt curtain to be installed during construction.
CONSIDERATIONS FOR ACTION:
1. The Commission will need to make a finding as to whether or not the proposed
activity/activities meets the criteria of being a “significant activity” as outlined in Section 2
(Definitions – Significant Impact Activity) the Montville IWWC Regulations.
Where uses/proposals meet the criteria of a significant impact as outlined above a public hearing
must be scheduled by the IWC. If the Commission believes the proposed activity does not meet
the criteria of a significant impact, I offer the following suggested language for a motion:
M O T I O N # 1 (Finding that there is not a significant impact)
I move that the Commission find that the proposed activity as presented by the Applicant in its
application, plans and the presentation made to the Commission at its September 1, 2016 special
meeting and at its September 15, 2016 regular meeting did not meet the criteria of a significant
impact activity as outlined in Section 2 (Definitions – Significant Impact Activity) of the Town of
Montville’s Inland Wetlands & Watercourses Regulations.
2. If the Commission is inclined to approve this application, the following language for a
motion of approval is suggested:

With due regard for the matters enumerated in Section 22a-41 of the Connecticut General Statutes
and in accordance with Section 10 of the Regulations for the Protection and Preservation of Inland
Wetlands and Watercourses of the Town of Montville, CT, I move to approve the application

submitted by Applicant, Dakota Partners, Inc., Property Owner, Faria Beede Instruments, Inc. for
Modification of Permit#213IWC18 for regulated activities in conjunction with adaptive reuse of
mill buildings for multi-family residential as described in the application, supporting
documentation, including Stormwater Management Report Dated September 2016, Project
Overview Dated August 30, 2016, Wetland Investigation Dated August 23, 2016 and Foundation
Support Adjacent Block & Silt Curtain Detail Dated September 9, 2106 and the plans entitled
“Oxoboxo Lofts, 42 Pink Row, Uncasville, CT, Prepared for Dakota Partners, Inc., Prepared by
BSC Group, Dated September 1, 2016, Sheets AC-1.0 Anticipated Conditions Plan, C-1.0 to C-
1.1 Erosion and Sediment Control Plan, C-4.0 to C-4.1 Grading & Drainage Plan, C-5.0 Utility
Plan and C-7.0 Regulated Area Disturbance.”
Standard Reasons for Approval:
1. The environmental impact of the proposed project does not have a significant effect on
the inland wetland's and watercourse's capacity to support fish and wildlife, to prevent
flooding, to supply and protect surface and groundwater, to control sediment, to facilitate
drainage, to control pollution, to support recreational activities, and to promote public
health and safety.
2. The Commission has determined that the relationship between the short-term uses of the
environment and the maintenance and enhancement of long-term productivity will have no
impact on the surrounding wetland system.
3. The proposed activity will not have irreversible and irretrievable commitments of
resources.
4. The proposed project will not change the character and or add degree of injury to, or
interference with, safety, health, or the reasonable use of property, including abutting or
downstream property.
5. The proposed activity use is suitable to the area.
6. The applicant has taken all feasible measures to mitigate the impact of any aspect of the
proposed regulated activity.
