An application for activity in upland review area in conjunction with clearing brush and
large boulders to be used in continuance of wall

History
When Rebecca Court was constructed it appears as though stockpiles and large boulders
were left on 5 & 6 Rebecca Court at the end of the Drainage Swale
Staff Comments
The applicant would like to move the boulders and place them along the back of property
where boulders have been placed by the developer
The applicant would like to remove all overgrown weeds and woodchips
The applicant would like to use a small excavator to clean-up weeds and woodchips and
to move the boulders; however, if it is not permitted the owner is capable of doing the
work by hand. The owner will not be contracting this project out
Pamela Brookes of 6 Rebecca Court was added to the application per the Commission’s
request to allow work to be on her property in the easement area.
The Commission conducted a site walk on July 8, 202. No action was taken

Draft Motion 1 (Permitted Use as of Right)
After giving due consideration to all relevant factors including those in Section 10 and or Section
4 of the Montville Inland Wetland Regulation and Section 22a-41 of the Connecticut General
Statutes, I move to approve application
221 IWC 11 – 5 & 6 Rebecca Court, Oakdale CT (044-015-004 & 003) Owner/Applicant:
Daniel Colemen & Pamela Brookes An application for activity in upland review area in
conjunction with clearing weeds and woodchips and moving boulders within the review area on
the property located at 5 & 6 Rebecca Court, Oakdale, CT. As shown on Assessor’s Map 44 Lot
15-4 & 15-3, as depicted in the application and narrative dated 6/2/2021 as a “Permitted Use as
of Right”
The work conducted is general maintenance and will clear up the easement area to alleviate
future drainage problems

located at 5 & 6 Rebecca Court, Oakdale, CT. As shown on Assessor’s Map 44 Lot 15-4 & 15-3,
as depicted in the application and narrative dated 6/2/2021.
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void.

1. The environmental impact of the proposed project does not have a significant effect on
the inland wetland's and watercourse's capacity to support fish and wildlife, to prevent
flooding, to supply and protect surface and groundwater, to control sediment, to facilitate
drainage, to control pollution, to support recreational activities, and to promote public
health and safety.
2. The Commission has determined that the relationship between the short-term uses of
the environment and the maintenance and enhancement of long-term productivity will
have no impact on the surrounding wetland system
3. The proposed activity will not have irreversible and irretrievable commitments of
resources.
