STAFF COMMENTS:
In Review:
- Application is for a permit for Regulated Upland Review Activities in conjunction with
Demolition of Existing Dwelling Units and Site Improvements for Future Stormwater
Management Improvements located at 21 Pequot Road, 23 Pequot Road and 17 Pequot Road &
Rte. 163 located in the industrial zoning district and owned by the Applicant, DW Holdings,
LLC. Demolition activities are proposed outside FEMA flood elevations.
- The purpose of the project is to demolish the two existing two-family dwelling units at 21
& 23 Pequot Road along with associated improvements in preparation for future stormwater
management improvements. Overall site work excavation is expected to be completed within one
week. The existing structures and all appurtenances will be demolished. Foundations will be
removed by an excavator and materials stockpiled outside the buffer and removed off-site and
holes will be filled and graded. A temporary de-watering hole/sediment trap is shown on the plans
& excessive water within the dewatering hole can be filtered and discharged to the brook via 6”
pvc pipe. The entire site along with dewatering operations will be lined with sediment fence. All
final grading will direct sedimentation runoff to the proposed sediment trap located in the middle
of the site such that sedimentation can be directed away from Oxoboxo Brook.

- Where uses/proposals are determined to meet the criteria of a significant impact as defined
in the Regulations, a public hearing must be scheduled by the IWC. A permit may be issued
without a hearing following the petition period 14 days after receipt of application, subsequently
action on the application may be taken at the July 20, 2017 meeting.
CONSIDERATIONS FOR ACTION:
1. If the Commission is inclined to approve this application, the following language for
a motion of approval is suggested:

With due regard for the matters enumerated in Section 22a-41 of the Connecticut General
Statutes and in accordance with Section 10 of the Regulations for the Protection and Preservation
of Inland Wetlands and Watercourses of the Town of Montville, CT, I move to approve
Application #217IWC9 submitted by the Applicant, DW Holdings, LLC for a Permit Regulated
Upland Review Activities at 21 & 23 Pequot Road (Map 72, Lots 42 & 41) and 17 Pequot Road
& Rte. 163 (Map 72, Lot 54B), Uncasville, CT in Conjunction with Demolition of Existing
Dwelling Units and Site Improvements for Future Stormwater Management Improvements.
as described in the Application & Project Narrative, Dated 6/7/2017 and the Plan Set entitled
“Existing Conditions Survey Plan, Site Demolition Plan and Details, 23 Pequot Road, Montville,
C, Prepared for DW Holdings, Prepared by BSC Group, Dated June 15, 2017.”
Conditions of Approval:
Standard Reasons for Approval:
1. The environmental impact of the proposed project does not have a significant effect on the
inland wetland's and watercourse's capacity to support fish and wildlife, to prevent flooding, to
supply and protect surface and groundwater, to control sediment, to facilitate drainage, to control
pollution, to support recreational activities, and to promote public health and safety.
2. The Commission has determined that the relationship between the short-term uses of the
environment and the maintenance and enhancement of long-term productivity will have no impact
on the surrounding wetland system.
3. The proposed activity will not have irreversible and irretrievable commitments of resources.
4. The proposed project will not change the character and or add degree of injury to, or interference
with, safety, health, or the reasonable use of property, including abutting or downstream property.
5. The proposed activity use is suitable to the area.
6. The applicant has taken all feasible measures to mitigate the impact of any aspect of the proposed
regulated activity.
