Repair of wall along Gardner Lake, creation of patio and steps, new retaining wall and
tree removal

History
The site consists of 0.31 acres and abuts Gardner Lake. There was a cottage on the
property since the 1970’s. A new Single Family Residence was built in 2019.
Staff Comments
The applicant is requesting permission to
o Install a flag stone patio with fire ring.
o Reinforce the existing stone wall along the lake with 6” to 10” stone and the top
course of wall stones will be reset
o Install 12 to 16 large stone steps and flag stone walkway for lake access.
o Construct new retaining wall around patio
o Remove a large tree that has significant die-off
Six (6) inches of top soil will be removed from the proposed patio and step area. This will
be set aside for finish grading.
All stonework will be constructed on a compacted crush stone base with stabilizing mat.
Patio and walkway jointing will be completed with polymer sand joint material
Equipment to be used on this site will be compact excavator, skid steer and rigging.
Affected lawn will be repaired with existing and new top soil and re-seeded.
Proposed start date is June 2021 and may take two (2) week for completion.
The dimensions of the area must be indicated on the plan in order to determine the upland
review disturbance area.
The Commission may want to hold a site walk.

"Significant Activity" means any activity, including, but not limited to, the following activities
which may have a major effect or significant impact on the area for which the application has
been filed or on another part of the inland wetland or watercourse system:
1. Any activity involving a deposition or removal of material which will or may have a
major effect or significant impact on the regulated area or on another part of the
inland wetland or watercourse system; or
2. Any activity which substantially changes the natural channel or may inhibit the natural
dynamics of a watercourse system; or
3. Any activity which substantially diminishes the natural capacity of an inland wetland
or watercourse to support desirable fisheries, wildlife, or other biological life, prevent
flooding, supply water, assimilate waste, facilitate drainage, provide recreation or open
space or other functions; or
4. Any activity which causes substantial turbidity, siltation or sedimentation in a wetland
or watercourse; or
5. Any activity which causes a substantial diminution of flow of a natural watercourse,
or ground water levels of the regulated area; or
6. Any activity which causes or has the potential to cause pollution of a wetland or
watercourse; or
7. Any activity which destroys unique wetland or watercourse areas having demonstrable
scientific or educational value.
Regarding Significant Activity finding, I offer the following suggested language for a
motion:

I move that the Commission find that the proposed activities in the wetlands and upland review
area as presented in the Application (221 IWC 4) and in the presentation made to the
Commission at its March 18, 2021 hybrid regular meeting, meets OR does not meet the criteria
of a significant impact activity as outlined in the Town of Montville’s Inland Wetlands &
Watercourses Regulations.

After giving due consideration to all relevant factors including those in Section 10 and or Section
4 of the Montville Inland Wetland Regulation and Section 22a-41 of the Connecticut General
Statutes, I move to approve application
This is a conditional approval. Each and every condition is an integral part of the Commission
decision. Should any of the conditions, on appeal from this decision, be found to be void or of no
legal effect then this conditional approval is likewise void. Should any of the conditions not be
implemented by the applicant or his successors within the specified permit time period, then this
conditional approval is void.
Conditions of approval are:

1. The environmental impact of the proposed project does not have a significant effect on
the inland wetland's and watercourse's capacity to support fish and wildlife, to prevent
flooding, to supply and protect surface and groundwater, to control sediment, to facilitate
drainage, to control pollution, to support recreational activities, and to promote public
health and safety.
2. The Commission has determined that the relationship between the short-term uses of
the environment and the maintenance and enhancement of long-term productivity will
have no impact on the surrounding wetland system
3. The proposed activity will not have irreversible and irretrievable commitments of
resources.

4. The proposed project will not change the character and or add degree of injury to, or
interference with, safety, health, or the reasonable use of property, including abutting or
downstream property.
5. The proposed activity use is suitable to the area.
6. The applicant has taken all feasible measures to mitigate the impact of any aspect of
the proposed regulated activity.
