David Nott Sr. Description of Activity: I have a recurring water problem in my lower level/basement of my raised ranch home and I have contracted out the work for installing footing drains to Kevin Ziolkovski of Summit Trail Excavation (860-608-3456). This would drain to a drywell and help shed water and relieve hydraulic pressure at the foundation and hopefully solve my water issues. The location of activity is the rear of my home and the left side of my foundation. My house is approximately 40 feet from the watercourse area itself as indicated by the diagrams provided by Kevin Ziolkovski. Kevin is using a backhoe machine and shovels to perform the work. Material used in this process consist of 4” PVC Pipe, ¾” Stone, Filter Fabric and PVC End Cap and PVC Coupler. The area to be excavated is 74 feet of trench, 3 ½ feet deep and 3 feet wide around the two sides of the house. Trench area/drywell pit that connects to main trench is 60 square feet. To complete this project we needed 7.7 cu yards of ¾” stone, 1 roll 4” PVC x 100 feet, 1 roll 4 feet x 100 feet filter fabric, 1 4” PVC Cap and 1 4” PVC Coupling. Material to be removed is trench dirt 42.07 cu yards, Composted yard debris approx 6 cu yards. Trench dirt will be backfilled and the composted debris spread on my property. The dirt type on my property is sandy once excavated, the watercourse area consists of dirt, loose rock and various, weeds and plants. I am asking for a permit for this activity to help solve my water problem in my basement. My house has been built close to the culvert/watercourse area and is therefore within it and not completely outside of it. This project would be completed in a day at this point when Kevin Ziolkovski can be allowed to return to complete it. Completion would help get me back on track to repairing my lower level/basement of my house, which had been damaged again due to the rainstorms in March 2010. Repairing my yard and re-attaching my steps to my deck, which had to be temporarily removed for the drains to be installed. The original plan of running the end of the drain to the culvert has been changed (to a drywell) due to the fact of my contractor digging a small distance onto my neighbors (Richard Holloway) property. The trench was filled and a area of yard debris was removed from the area itself. Over the years previous homeowners and myself have put our crass clippings, pine needles and such in the corner of the yard. Richard mentioned that it appeared to be coming over onto his property. Richard mentioned he and his wife had plans to clean up the culvert area, plant plants and put a small wooden bridge over the water that comes down the hill. In an effort to not cause any further issues between my neighbor and I, I informed him I would have the area fixed and remove the debris. As it stood at this point, my contractor, Mr. Holloway or myself never knew anything about the 50 ft regulated area ordinance in the Town of Montville. Colleen Bezanson, Wetland Officer from the Town of Montville arrived Thursday May 13, 2010 after speaking with Mr. Holloway about the work being done earlier in the week. She informed Mr. Holloway (who arrived shortly after Ms. Bezanson) and myself of the 50ft ordinance restriction in a wetlands or watercourse area. She informed me of the cease and desist order, informed Mr. Holloway that he cannot alter the culvert area and only remove trash if found by hand. I explained to Ms. Bezanson that this work would have never been started had my contractor known or if I had known, as this type of work is hugely disruptive. As long as I had lived at this address I have not known of that ordinance. I had no desire to do any work like this without the proper permits being filed. Ms. Bezanson gave me instructions on how to file for a permit and that I would have to appear at a public hearing on Thursday May 20, 2010 at 7:00pm. Ms. Bezanson did allow my contractor to backfill the area from my deck around the left side of my home farthest away from the watercourse area. I was instructed to do no more work from there over to the watercourse area. As instructed by Ms. Bezanson silt fence was installed and plywood placed over my existing excavated holes. Area also surrounded by caution tape as well.
