Dear Ray:
This office is prepared to issue a certificate of use
and compliance for the home and garage at Lot 22, Pruett
Place in Chesterfield Acres Subdivision only upon its
compliance with required zoning setbacks. At this time
the structure is 9 feet closer to the front property line
than permitted by Montville zoning regulations.
The property owner has applied for a variance, to be
considered by the Zoning Board of Appeals. If this vari-
ance is not granted, this official will issue an order
requiring correction of this violation immediately. This
order would probably be issued after January 7, 1982.

In reference to the request for a variance request to the Town of Montville
Zoning Board of Appeals, I am fully aware that if the variance is denied, I
will reconstruct the garage on 75 Pruett Place, Montville, and have estimated
the total cost of labor and materials necessary to do this will be approximately
$2200. This amount shall be set aside and held by my attorney, James Murphy,
to be released only after all zoning requirements have been met.
It is further understood that if the variance is granted, then the $2200
shall be released to me.
