Cote 70 Pruett Place Oakdale, Connecticut 06370 May 13, 1994 Mr. George Thompson Assistant Manager American States Insurance 700 Stanley Drive New Britain, Connecticut 06050-9010 RE: CLAIM #121 0036 548 INSD - PAUL R COTE POLICY #HE 06 036 017 LOSS DATE - 3/13/93 Dear Mr. Thompson, In your letter dated May 5 , 1994 you notified me that my policy does not cover the situation stipulated in the above claim. Your reason is stated that "movement of the chimney is the result of settlement at the foundation level". I intend to show that you are not in possession of all of the facts concerning the above claim. I trust that your determination is based principally on the inspection of the fireplace by your consulting engineer, C. Michael Horton, P. E. in April of 1994. That inspection, which was witnessed by my wife and me, consisted only in a visual inspection after which several photographs were taken. We do not feel that the inspection was thorough or founded in good engineering principles since Mr. Horton took no measurements, did not ascertain if the fireplace footing was adequate, did not discuss the town' s building codes, nor did not ask to see the construction plans for the dwelling. Furthermore, he stated that one of the signs of settling was the depression in the ground north of the chimney. I informed him that I had relocated an flower bed from that exact location in the fall of 1993 in anticipation of repairs and had moved the soil as well to minimize disturbance to the plants. I did not fill in the depression and that is the cause of the depression. The absence of vegetation in the depression at the time of his visit supported my statement. The chimney problem was first detected coincident with one of the many storms that we have experienced. While the problem may not be directly attributable to any particular event, the following may convince you that the problem was revealed to us by weather, which is covered, and/or by collapse brought about by weight of contents and/or defective methods in construction, which is the root cause and also covered by our policy. First of all, the plans for the house call for a foundation which should have been poured to include a footing or base for the chimney as part of that foundation. Due to an oversight by our builder, this was not done. Construction plans can be produced upon request. Our town Building Inspector , Mr. Russell Stauffer, informs me that when I commissioned the building of the house, the town code called for the footing to be 12 inches thick, extend six inches out from the fireplace walls and be located forty two inches below grade. An inspection with a spade would be necessary to determine if the builder conformed to this code. Furthermore, the footing may not have been inspected by the Town' s Building Inspector at the time of construction because the plans filed with the town illustrate the chimney footing as part of the foundation. Additionally, he stated that if the footing is installed on natural undisturbed earth, no special preparation is required, but in our case, fill was used to bring the grade up to the proper level. Photographs are available to support this. A building code requirement exists to compact disturbed earth to 90 percent density and that a compaction test may be performed but is not required. During the construction period, my wife visited the site daily and observed no heavy equipment such as would have been required to perform the compaction. Mr. Stauffer informs me that there is no record of a compaction test on file with the town. Secondly, the fireplace was constructed with what now appears to be entirely too much material. It is a single flue chimney, yet is 47 1/2" wide, 26 " deep and extends 16' 10 " at its narrowest part to the peak. By comparison, our double flue chimney which exists near the center of the home is 26" wide by 17" deep, almost half the size. Near the base, the chimney in question is 70 " wide, 26" deep and is 90 " inches high before it reduces to the 47 1/2 " width stated above. This insufficiently prepared foundation, and excessive bulk of the chimney is not in accordance with our building plans. Additionally, we feel that the abnormal width of the fireplace at its peak where it is unprotected from high winds such as were experienced during hurricanes or other storms exposed it unnecessarily because of its ill advised construction. We could hear the chimney banging against the house during the fiercest weather, and the separation from the house became the most obvious in March of 1993 after the winter hurricane, but most likely was the cumulative effect of many storms. Thirdly, we have been told by people experienced in construction and by Mr. Stauffer that fasteners which hold the brick to the structure must be applied between the chimney and the home all the way to the top. The separation between the house and the chimney is so large that it enables anyone to see that there are only two fasteners, and the highest is approximately 12 ' 10 " above the ground. Is this sufficient for a 24 ' 4 1/2 " chimney? We intend to commission our own consulting engineer and consult with the State' s Insurance commissioner and our lawyer if that should become necessary.
