Uncasville, CT 06382 L ATTN: Ray Dawson J Dear Mr. Dawson, We at the Faria Corporation have submitted plans and specifications to install a "Ground Water Recovery System" to the Connecticut D.E.P. for approval. We have also applied for a "Point Source Discharge" Permit from the Connecti- cut D.E.P. The system will work by pumping contaminated ground water from our recovery wells and spraying it through spray nozzles into the air where the contaminant will evaporate. It is estimated the system may have to operate from five to ten years. As part of the D.E.P. 's review of our plans they have requested a written response from our town Building Department as to what approvals-permits if any would be required. Of particular interest would be the eight foot fence to surround the lagoon and the three small enclosures we will need to protect the pumps from the weather. I am enclosing prints of the lagoon and enclosures. Your attention to this matter will be deeply appreciated. If you have any questions or comments please feel free to call me at 848-9271 ext. 247. After a careful review of the zoning regulations to ascertain the applicability of those regulations to the project , this official feels that the proposal does not require zoning approval to commence operation. This finding is based on • the following circumstances: 1 ] The proposed enclosures are small and of a jgjn;orary nature . 2] The proposal should not be considered an individual land use due to the fact that it is concerned with recovery of hazardous material in the public interest. 3] Although not strikingly similar to the concept of an ornamental well, these shelters do serve somewhat of the same purpose ; ornamental wells are explicitly excluded from the definition of structure in the zoning regulations . This shall serve as the formal interpretation of this office in this matter. It should be noted that the interpre- tation is made with the understanding that the enclosure shall be eliminated upon recovery of hazardous material. Pink Row Uncasville, Ct. 06382 Dear Mr. Arpin, This is in reference to the receiver lagoon of the reclamation project. I will require that the lagoon be treated as a pool under the jurisdiction of the Connecticut Basic Building Code. As such we will issue a pool permit subject to the engineered stamped plan of the site and a letter from the engineer confirming the as-built results before a Certificate of Occupancy is issued. The Code implies physical , 'Mechanical and electrical compliance. This will include compliance with the current National Electrical Code, Article 680. The indicated fencing is more than adequate. Appropriate grounding is necessary. We will issue a permit, building and electrical when it is confirmed by the Zoning Enforcement Officer as an acceptable use or not regulated. Please note the ground fault requirement of the National Electric Code for this type of installation.
