Dear Sir/Madame, You are hereby ordered to discontinue the violation at the above referenced property under Section R-106 of the CABO/One and Two Family Dwelling Code. (see enclosed) The violation consists of finishing a room in the basement without required permits, as per a signed complaint. Also Section 105.0 of the Code was violated when the Building Official was refused entry to the premises on 5/25/89. Stauffer Acting Building Official RS: sp cc: Town Attorney File Part I—Administrative Chapter 1 ADMINISTRATIVE Section R-101—Title These provisions shall be known as the One and Two Family Dwelling Code, may be cited as such,and will be referred to herein as"this code." Section R-102—Purpose The purpose of this code is to provide minimum standards for the protection of life, limb,health,property,environment and for the safety and welfare of the consumer, general public and the owners and occupants of residential buildings regulated by this code. Section R-103—Scope The provisions of this code apply to the construction,prefabrication, alteration, repair, use,occupancy and maintenance of detached one-or two-family dwellings and one-family townhouses not more than three stories in height,and their accessory I structures. Compliance with the requirements of this code may be considered as prima facie evidence of compliance with the locally adopted code. Section R-104—Authority The building official is hereby authorized and directed to administer and enforce all of the provisions of this code. Section R-105—Entry Upon presentation of proper credentials, the building official or his duly autho- rized representatives may enter at reasonable times any building,structure or prem- ises in the jurisdiction to perform any duty imposed upon him by this code. Section R-106—Violations and Penalties R-106.1—Unlawful Action.It shall be unlawful for any person,firm or corpo- ration whether as owner,lessee,sub-lessee or occupant to erect,construct,enlarge, alter, repair, improve, remove, convert, demolish, equip, use, occupy or maintain any one-and two-family dwelling in the jurisdiction or cause or permit the same to be done,contrary to or in violation of any of the provisions of this code. R-106.2—Violations. It is hereby declared that any violation of this code constitutes a public nuisance,and in addition to any other remedies provided by this code for its enforcement, the city may bring civil suit to enjoin the violation of any provisions of this code. If for any reason any one or more sections,sentence clauses or parts of this code are held invalid, such judgment shall not affect, impair or invalidate the remaining provisions. R-106.3--Penalty.Any person,firm or corporation violating any of the.provi- sions of this code shall be guilty of a misdemeanor and each such person shall be One and Two Family Dwelling Code deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed,continued or permitted,and upon conviction of any such violation such person shall be punishable by a fine,or by imprisonment,or by both such fine and imprisonment as established by local applicable laws. Section R-109—Permit R-109.1—Permit Required.A permit shall be obtained before beginning con- struction,alteration or repairs,other than ordinary repairs,using application forms furnished by the building official. Ordinary repairs are nonstructural repairs and do not include addition to,alteration of,or replacement or relocation of water supply,sewer,drainage,drain leader,gas, soil,waste,vent or similar piping,electrical wiring,or mechanical or other work for which a permit is required by the building official. R-109.2—Permit Fees.Permit fees shall be established by the local jurisdiction.
