Uncasville, Ct. 06382 \ tt 'y 3/30/09 To: Mayor Jaskiewicz From Vern Vesey, Building Official On February 18, 2009, the owners of the properties at 36 and 46 Platoz Dr. applied for modification of the Connecticut Building Code requirement for installation of sprinkler systems in two, eight unit apartment buildings. As required during the modification process I sent my comments to the State Building Inspector. For safety reasons I did not support the request. The Fire Marshal agrees with my concerns for the safety of the tenants. On March 30, 2009, I received a copy of the State's approval of the request. Per Connecticut General Statute 29-254"Any person aggrieved by any decision of the State Building Inspector may appeal to Codes and Standards within 14 days" I am requesting your permission to seek the advice of counsel as to whether a Building Official or Municipality may appeal the State Building Inspectors decision. If counsel confirms that a Building Official may appeal, I am asking your permission to enlist the services of counsel to pursue such appeal Re :- � ' ernon D. Bruce Chudwick Bruce, Yesterday I faxed you the information concerning my request as to whether or not I am allowed to file an appeal of the State Building Inspector's decision to offer a modification of the sprinkler requirements at 36 and 46 Platoz Dr. in Montville. I am sending this fax to make you aware that the owner of the properties was in today asking if I have received the modification from the State, and when I will be issuing his permits. I told him that I was considering filing an appeal of the modification and asked that he contact me next Monday. I told him I would try to have a decision by then. Middletown, Ct. 06457 Re: Request for appeal of State Building Inspector's decision re M-152-09 and M-153-09 re 36 and 46 Platoz Dr., Uncasville, Ct - A-28-09 We wish to appeal the decision of the State Building Inspector regarding code modifications M-152-09 and M-153 -09, allowing two R-2 uses to be completed without providing sprinkler protection. According to the approvals, her decision is based on the fact that "existing conditions preclude compliance with requirements for new construction and that when the building was originally constructed, sprinkler protection was not required". It is our contention that these structures, which were exterior framed only and then abandoned for over thirty years, are not existing structures according to section 202 (definitions) of the 2003 IBC and section 101.2 of the 2003 IEBC portions of the 2005 Connecticut Building Code. The interior framing of the buildings is not complete and no HVAC, Plumbing or Electrical systems have been installed. INITIATING APPEALS An appeal may be initiated by sending written notice by U.S. mail, email or fax to the Office of the Codes and Standards Committee, Department of Public Safety, 1111 Country Club Road, Middletown, CT 06457-2389 (FAX 860-685-8365). The deadlines for filing a timely appeal are listed below and also may be found, along with other pertinent information, on the Statutory Authority Matrix. Please note that the statutory filing deadlines are mandatory. The Committee does not have authority to consider the merits of a late appeal. The voluntary Request for Appeal to the Connecticut Codes and Standards Committee questionnaire form should be returned within 14 days of receiving it, or as soon as practicable, so that the Appeal Panel assigned to the appeal will have sufficient information at the time of the hearing. However, your appeal is considered filed upon receipt of a letter or other written notice indicating that you wish to file an appeal. It is not necessary to file the Request for Appeal to the Connecticut Codes and Standards Committee in order for your appeal to be processed. Upon receipt of the appeal, the Codes and Standards Committee will assign a file number and will schedule a hearing 30 days or more from the regular meeting next following the date of receipt.
