Dear Mr. Rice,
This is to confirm that, based on the attached
correspondence, I am willing to issue the second permit
to remodel the building on lot 17I for 8 units.
I have done this based on the fact that this lot 17I
exits on Derry Hill Road, not Platoz Drive, which is nota
town accepted road.
In accepting this permit it is understood that in
the event that Platoz Drive ends in controversy you will
also maintain the C. 0. for both Lot 17 D,E,F,G, and 17 I
with an entrance on Derry Hill Road.
It is further understood that this exit to Derry
Hill Road for these combined lots will not be split for
the combining lots as long as the Town of Montville has
not accepted Platoz Drive.
It is further understood that both permits 17 D,E,
F,G, and 17 I will be subject to connection to Phase II
sewer construction before occupancy of either building.
This agreement shall remain in force until both
buildings are completed by you or others and road is
accepted.

It has come to my attention that Mr. Ray Rice is requesting
requisite remodeling permits under authorization of your 1980
ruling as Zoning Enforcement Officer in order to permit renovation
of the apartment building at the corner of Derry Hill Road
and the so called Platoz Drive .
Based on prior verbal and written agreements associated with
this situation, and upon prior interpretations and issuance
of similar permits for the apartment building located on
Lot 4 (Derry Hill Estates Subdivision) , this office has no
authority or jurisdiction in this matter .
I would recommend that Mr . Rice provide some intent to you ,
provided he has not already , that indicates that the lands
to be combined will in fact be combined prior to issuance of
any Certificate of Occupancy at either site . This standard
should, in my opinion, be clearly understood to avoid compli-
cations which might arise from conveIance of this property
after the building permit(s) is7are issued.

five ( 5) lots into two ( 2) lots provided he will not be

be certain that any possible controversy is behind him so
that he will not be prevented from additional development
should his present venture not materialize .

Dear Mr. Rice:
This is to inform you that the Planning and Zoning commission
members concurred with my findings at the July 8, 1980 meeting.
Based upon their concurance I am now willing to issue you remodeling
permits for the two pieces of property in question on Derry Hill,
subject to an engineered subsurface sewage disposal system approved
by Don Capallaro of the Connecticut State Health Department, for
two (2) eight single bedroom units each.
