RE: 38 Pequot Road
Accept this Notice of Unsafe Structure as per 152.001 of the Montville Ordinances.
Per section 119.0 of the 1996 BOCA portion of the State of Connecticut Building Code and the
Connecticut Supplement to the Code, the Town of Montville Building Department, for the
following reasons, hereby deems the structure located at the above referenced address as
Dangerous and Unsafe:
1. Undermined foundation
Repairs or improvements must be made to abate the unsafe conditions described above or the
structure must be demolished. A plan of compliance acceptable to the building official or
stamped and signed documentation from a Ct licensed Professional Engineer that the structure is
not in danger of collapse must be presented to the Building Department within 10 days of receipt
of this notice.
Per section 119.3 of the 1996 BOCA portion of the State of Connecticut Building Code, you are
required to declare immediately to the code official acceptance or rejection of the terms of this
order.

Dear Mr.Joseph Summers;
This letter is in response to a letter titled"Second Notice of Violation"from you on behalf of the Town
of Montville Building Department dated the 22nd of March 2002,for my property located on 38 Pequot
Road. The house in violation is currently a vacant single-family dwelling.
After receiving the first notice of violation we asked the tenant(Clean Harbors)to vacate the premises.
They have since vacated the premises.
We are currently looking at several options in regards to the above-mentioned single-family dwelling.
Options included:
A—Selling and moving the above mentioned house
B—Demolition of house
C-Converting over to office for sales and dispatch.

Dear Mr. Summers;
This letter is in response to your letter dated June 7,2002. Please see attached.
Since our last correspondence with you on March 29,2002,we obtained on April 23,2002,a zoning and
wetlands permit to remove the building to make space for outside storage and a parking lot. See attached
paperwork.
The building is a single-family dwelling and is still vacant. We have purchased two lots on Hamel Lane in
Uncasville and plan on moving the building as mentioned to one of those lots. The sale of these lots is final
and we should be closing within two weeks. We are currently putting a plan together with our surveyor,
Mike Healey and Associates,to submit to the town for approval of the building to be placed onto one of
these two lots.
Any excavation we are currently doing around the building is at the request of the building movers,C.W.
Movers of Westerly,Rhode Island,that we have hired.

Accept this Notice of Violation as per Section 152.001 of the Town of Montville Ordinances.
You are hereby ordered to discontinue the violation at the above referenced property under the
1995 CABO section 106 or the 1996 BOCA section 116.0, as adopted as the Connecticut State
Building Code.
You must STOP WORK as per 1995 CABO section 118.0 or 1996 BOCA section 117.0 and
contact the Building Department within ten (10) calendar days with a plan of compliance in
order to avoid possible legal action.
The violation consists of

CONDITIONS:
1) The final paving shall include a pavement overlay of the full width of Pequot Road
along the property frontage. The pavement detail on the site plan shall be revised
to reflect this improvement.
2) Erosion and sediment control measures shall be placed at the existing catch
basin inlet in Pequot Road.
3) Existing and proposed catch basin sumps shall be cleaned of accumulated silt
upon completion of the site improvements or as necessary during construction
activities on the site.
4) The gross particle separator detail shall be revised to be consistent with the
design requirements indicated in the drainage report. The final design must be
approved by the Town Engineer
5) The applicant/owner must submit an annual report to the Director of Public Works
indicating that all sumps/gross particle separators have been cleaned
6) The applicant must obtain all necessary Town roadwork permits from the
Department of Public Works.
